I-130 & I-485 (And supporting documents) question

Default I-130 & I-485 (And supporting documents) question

Sent in my I-130, I-485, and all the supporting documents to the Chicago
Lockbox July 26th.

Mailed it to them Overnight, Registerd with signature required. The little
slips from USPS has already come back with a stamp instead of a signature,
no big deal.

Question is, how long before I get a notice from USCIS with a receipt number
so I can check the progress?

I searched Google, Yahoo etc..., but came up with more questions than
answers, as some state they never got one before being approved and some had
them in a couple of weeks.

Any suggestions?

Background: Married U.S. Citizen 5 years ago, lived in the U.S. for 20
years August 25th, 2007.

There might have been a huge number of applications coming in to USCIS around the time you sent yours in (just before a major fee increase). I believe there is a memo floating around somewhere from USCIS which says they will be backlogged in getting NOA's out (something to that effect). So it might take a while...maybe a month or so...before you receive an NOA.

If you check the back of your canceled check, you may be able to see a reference number there (3 letters followed by about 10 numbers).

I am curious why you are only filing for PR now - in what status have you been living in the US for 20 years...

WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) announced today that it has experienced a tremendous increase in the number of applications filed, which has resulted in a front log of cases awaiting data-entry. USCIS is making every effort to address the delay.

USCIS will prioritize data entry for specific form-types. Delay in data entry and fee receipting will not affect Change of Status or Extension of Stay eligibility, assuming all other eligibility requirements are satisfied. USCIS would also like to assure its customers that requests for Premium Processing Service will continue to be processed within 15 days, consistent with existing policies and procedures.

The actual received date will be honored and recorded on the receipt notice. This date will appear in the “Received Date” box on Form I-797, Notice of Action. The received date on Form I-797 is different from the “Notice Date,” which also appears on the Notice and identifies the date the receipt notice was actually generated.

USCIS will provide weekly updates to give our customers accurate information about current receipt times and service level commitments. As of the date of this notice, USCIS has completed data entry and has issued receipt notices for applications and petitions received on or before the following dates:

the average wait time for a receipt notice is around 3-6 weeks after
filing. you can also find the receipt number at the back of the
returned check.

what i don't get is why bother checking once you have receipt number? It's a couple of years for approval then many more for priority date. Sit back and relax.

This is not true if he's filing based on marriage to a USC. AOS approval can come as quickly as 3 months, or up to a year later. No wait for a priority date, as the spouse of a USC a visa number is immediately available to him.

The checks still have not cleared, and still no receipt number for USCIS. I
know I'm just rushing things, and after waiting 20 years, another few months
should be a breeze.

For the past 20 years I have been in and out of status. (illegal) From 87 -
90 I was in school, here legally, then in 90-92 i was 'overstaying'. In
Dec. 92 I had to return to Norway for a wedding. Claimed I had "lost" the
I-94 when leaving. Came back 3 weeks later with a 6 month I-94. So to make
a long story short(er), I've been out of status since June 93.

Thanks for the heads up. I didn't even think about going to "the source"
for information. LOL.

Looks like they are getting close to my date according to the latest one.

Quick question, if someone knows, I filed an I-130, which is not listed on
the CLB, do I use the I-485 date?

"Sit back and relaz"????? Are you nuts? LOL. (kidding of course)

I know it'll take time, and once I have the number I still have to wait a
while. You'd think I would have more patient after 20 years, but no. LOL

Oh dear. You could have a problem.

When you returned after having "lost" the I-94, you were not actually legally admitted - because you had no right to be admitted, being subject to a 3 year ban (or is it 10 years?), due to your overstay.

Someone who has not been legally admitted cannot adjust status. There was a case here of a British woman who was in a very similar situation. I believe she ended up leaving the US (rather than be deported), and if memory serves me right was last heard of trying to get a waiver from the UK.

Advice from an experienced immigration attorney might be a good idea...
