i-130, i-485, K3?

Default i-130, i-485, K3?

I’m a US citizen and my wife is Canadian, and we reside in Canada. I filed an I-130
to Nebraska and just received notification of receipt.

However, someone just told me that it would be better to file the I-130 with my wife
at the local office in the US where were are moving. The question arose whether it
would be faster to file a new I-130 or to request that the one I sent to Nebraska be
transferred. Should I refile?

I also don’t understand what to do next. I’ve seen discussions of K3 Visa but a
lawyer mentioned that I should do an I-485. All I seem to find is vague, conflicting
advice. What do you do after filing an I-130?

If you are married, you could be filing I-130, I-485 and I-765 all at the same time
if your spouse is in the US.

If your spouse is not in the US yet, you could now file for a K-3 since you already
filed for I-130. It seem to be taking 2 to 12 weeks for K-3 visa now.

Your wife might be refused if she doesn't have an Immigrant visa "IN HAND" when you
arrive at the border to move to the US permanent. She's Immigrating, therefore she
needs an Immigrant visa to come.
