Hi To All:
I have a couple questions to ask concerning permanent residency. My
wife is a Canadian and we have been married for over four years now.
I am an American citizen. We lived in Canada for more than three years
and were married there. She is currently living with me in the United
States on an L1-B (specialized knowledge) visa. She does reasonably
well financially and works for a well-known company. My wife still
has about two years left on her original L1-B permit.
The question I have is this. A couple INS officials and a lawyer for
my wife’s company told her that with her having a good job, the
fact that she is in the United States on an L1-B and with her having
been married (to an American citizen) for over four years all will be
of help when it comes to the residency process. I hope that they are
correct but what I am really interested in is what are the best sites
and resources for gathering all of the paperwork for my wife to become
a permanent resident of the United States. I have found some very
good sites, but I cannot seem to find anyone that has a similar
situation to mine. That is making me wonder does my situation require
the I-130 and the I-485 or just the I-485 or possibly something else?
I really want to know what forms I need to complete and get this
process going as soon as possible. I just want to know what is the
best way to have my wife stay in the United States permanently.
I have received a fair amount of suggestions from people concerning
this issue and some even mentioned that my wife could attain permanent
residency on her own, but I would assume that her ties to me would
make it easier than doing it on her own? We have no children to
complicate matters. The only problem I can foresee is that I am
unemployed at the moment and living in an area that is not going to
emerge from the recession anytime soon; but, as aforementioned, my
wife does well. I dont know if it is like the K-1, the I-130, because
my parents do very well and would be glad to sponsor my wife. I dont
know if that could help me avoid any complications or not? This
really concerns me.
I am sorry for going on for so long and that I have so many questions
but all of this is so confusing and upsetting. I am very concerned
that I am not employed at the moment and wonder if my wife can file
the affidavit of support jointly; her W2 is quite good. Any
information or suggestions would be greatly appreciated.
Thank you to all that read this message and reply,
Jeff

Her income can be used to sponser her.
She would file I-130 and I-485
