Default I-130 Filing With Spouse in USA

Hi Everyone,

My fiancee and her two daughters (6 and 11) moved here to Dallas from Rio de Janeiro
on February 19 with a 6 month tourist visa. We got married on May 29 and now her 6
month visa will expire August 19 so we need to act quickly.

Can anybody help us out here? We can't hire an attorney right now so we are doing
it ourselves. From what I understand, we just need to file the I-130 for now,
which includes:

- I-130 form completed
- G-325A Biographical Information form for myself and my spouse - are there separate
forms required for her two daughters?
- recent passport style photos of myself, my wife and her daughters (are the photos
for the daughters needed yet?)
- copy of either birth certificates or passports for myself and my wife (again, what
about the girls?) Also, we don't have birth certificates - will copies of passports
suffice? That's what it seems to indicate but I just want to be sure...
- copy of our marriage license (does it have to be certified)?
- copy of our divorce decrees (we've each been married before)

I send all this and a money order for $130 to the Texas INS center. When I get
something saying they received the petition, she is "safe" as far as overstaying her
tourist visa - yes?

At what point can I apply for the permission to work and travel while the I-130 is
being approved?

That's all I can think of for now, but that's plenty - we want to get this thing in
the mail on Monday!

To adjust status, you will also need I-485 and its fees. By the way, you need the
I-130 and I-130 for each person. (I am positive about the I-130, almost sure
about the 485

That info is what the immigrant does.

The I-130 is what the US citizen files. More info on this is found in the I-495
instructions. http://www.ins.gov/graphics/formsfee/forms/i-485.htm

As I have staed before, this is one I-130 and one I-485 for each person. The I-485
itself is $255.

If anybody has any experience obtaining V-Visa in USA. Please post here. I would like to know how long it took, where to file etc...... I am a green card holder and my wife is a 2nd preference category,waiting for a priority date. I already have an approved I-130 and wanting to apply for a V-Visa!!!!!!!!!!!!!!Please let me know how the procedure is...... thanks in advance for any help...

Does she meet the requirements of the V Visa according to:

1. Had a I-130 filed on their behalf on or before Dec 20, 2000 and
2. Has been waiting for at least 3 years after the I-130 was filed
