I-130 filing question

Any one has any experience filing I-130 personally i.e., without going though an
immigration attorney?

Good idea? Bad idea?

This is a repost...but it's the same question so here's the same answer I
posted before =)

I like you, went through the, "Should I get a lawyer?" I posted to this NG, and my
lawyer wanted $2500 for the paperwork. If you have the money to burn, sure why not,
but for me, with the advise of this NG decided against it. Why?
1. Too expensive.
2. Lawyers can make mistakes (and have)
3. Who knows more about your information? You or the lawyer?
4. The paperwork, though tedious, really is not all that difficult.
5. If you have any questions, this NG and the numerous websites are very very
helpful, use them! =)

Sure if you get a lawyer you won't have to worry about the paperwork, but please
remember they are not infallible. Also, when we submitted our paperwork the INS
officer checked everything we submitted. She went as far as to make a correction on
one of the forms.

So, I would say do it yourself =) We did and I am so glad we didn't pay the $2500 for
something that turned out to be not so difficult in the end!

We did and will have our interview April 12th. I-130 went through the process at the
NSC as if I was out of the country and got approved. DO NOT SEND THE I-130 AND I-485
TO THE SERVICE CENTER - SEND IT TO YOUR LOCAL INS.

Am I missing something here? Why would you not send the I-130 to your service centre?

Even when I tried to do DCF from my spouses home country, I was told it would go to
the service centre.

Please explain why you were able to send to your local INS office. My one is only
about 3 blocks from my office, and they always answer their phones!!!

Simply because they were both living in the US and the AOS interview will be
in the US.

As for the DCF, the I-130 is filed at the US Consulate and not at the service center
level if both the USC and the foreign spouse are living overseas together. Some US
Consulates will waive the living requirement for the USC but not all. It appears
that the particular US Consulate in question was not going to waive that requirement
in your instance and was insisting that you go the traditional filing of the I-130
at the US Service Center level with the AOS interview for the foreign spouse at the
US Consulate after its approval. This is in no way to be confused with direct
consular filing.

Note I said I-130 and I-485. I-130 alone goes to the service center. It was a costly
(as in time) error I made.

Does this mean that if you marry in the states and submit both I-130 and I-485 to the
district office as instructed, they send the I-130 to the service center to be
approved? Linda (through requesting status updates and contacting congressman and
lawyer this week)

Not if the marriage is between a foreign spouse and a USC. That is the difference.
With a USC spouse, there is no time wait for a visa to become available such as with
a foreign spouse and a PR spouse. In that instance the service center will approve
the I-130 based upon when the date becomes current.

Everybody's experience is different. We hired an attorney, because the processs was
taking so long. The attorneys never had to intervene for us, but I am still glad we
hired them. They gave us a lot of good advice and walked us through the process. If
you are not having many problems, I would not hire an attorney. If you are, I would
recommend hiring a good attorney.
