I-130 and EAD

Default I-130 and EAD

(1) Does a person who is I-130 pending (though sibling's aponsor)
automatically eligible to apply for EAD? What's the chance to get the
EAD. I read on the website that the person must provide evidence
needing to work.

(2) What happend when someone applied for EAD - and already received a
letter confirming that the office has received the application - and
all of a sudden plans to move to another state before hearing from the
office again.

What should the person do? Can the person write to the office ahead
of time of the date of move to inform the date that the peron will not
be the current address and also provide the new address? SInce the
person is moving to ANOTHER state, how would this play out? Would the
person has to reapply from the first step?

No. A pending or approved I-130 does not give you any immigration
benefits. You need to have a pending I-485 to be able to apply for an EAD.

In the instruction area of the application form for EAD where it
explains what to submit for the type of category one is in, the
instruction for soemone with I-130 pending is that if the person can
prove the need to work, he/she can apply for it. Doesn't that imply
that one has a chance to get EAD though not automatically eligible
just because one is I-130 pending.

How does one prove the need to work?

I have looked through the instructions for Form I-765, and have not found a
reference to Form I-130.

I have found no wording to the effect that if a person can prove the need to
work (in any category of eligibility), he/she can apply for it. Could you
be more specific about which page of the instructions you are seeing, and
quote it at more length?

Doesn't that imply
