Default I-130 CHILD FROM PREVIOUS MARRIAGE

I'm getting all the documents together for the I-130 petitions for my husband and 2 children (I'm the USC). My husband has a daughter (aged 17) from his previous marriage who she lives with her mother, so I will not be submitting a petition for her. Do I need to provide something additional to say why she's not joining us (i.e. that her mother has custody) or will they automatically assume that when they see the divorce certificate?

If the 17 year old daughter is not immigrating, you don't need to do anything special. Just make sure she is listed anywhere it asks about his children, even if she's not immigrating.

Someone will probably ask you at some point, so I'll bring it up now. Your husband's DD might want to come to the US one day, and she does have a limited opportunity to do so based on your relationship to her father.

What country are they in? In the United Kingdom, the notion of "custody" disappears when a child turns 16, as a general rule.

Does she want to come to the U.S.?

She is in South Africa. At this stage I don't think that she'd want to go to the US, at least not in the next few years.
