Default I-130 from Canada to US

Hello!

My husband is a US citizen (Canadian PR) and we are living in Canada. We
are planning to move back to the US in 2006...and are wondering if the I-130
is our way to go. We have been married for 2.5 years, is it true that I
will not need to file for I-485 once in the US? Will I get my "spousal
visa" and "green card" interview...one and the same?

Thanks to anyone who can advise. :o)

If you apply for an immigrant visa and get it, you will not need to
file for I-485 once in the US.
You will be come a permanent resident at the time you enter in the US
(you will have a stamp valid 1 year - and should receive the actual
card soon after in the mail)

Dittos on the immigrant visa, aka "IR-1". Check out http://www.visajourney.com/forums/index.php?pg=compare . Your choices are K-3 and IR-1 (K-1 is for fiances rather than spouses, and DCF is not available in Canada).

K-3s used to be the way to go because IR-1s took so long. Now IR-1s are processing faster than K-3s.

To get an IR-1 (which you can get rather than a CR-1 because you have been married for over 2 years) your husband would file I-130 for you. Eventually you get a spouse interview (has to be in Montreal for IR-1 I think). Then you get an IR-1 visa in your passport. You have to travel to the US on the IR-1 within six months. Upon entry to the US they give you an I-551 "green card" stamp in your passport.

Voila, as said previously you are a permanent resident. No AOS.

You might want to have a look at the K-3/IR-1/CR-1 forum at www.visajourney.com/forums .

Good luck,
Joe
