Hi,

Somebody told me something that confused me a lot. Now I wonder if the form I-130 is needed to AOS?

I was in the US when I married a USC. We filed the 1-130 (his application for his alien spouse) and I submitted to I-485 to adjust my status on the basis of that application. In this situation BOTH are needed.

Others who marry abroad can file an I-130 at the consulate (DCF) and obtain an immigrant visa (I think) that way.

I bet there are many other uses for the I-130..(probably spelled out on the form). To make it easier to answer your question what is your situation and what were you told?

Right now I am a student (F-1), and in a week I am getting married to USC.
I read on the INS website what's the use of I-130, but it's not too clear for me.
On the same website, there also is written what forms are needed for the AOS, and they don't mention I-130 (?)

I am getting more and more confused everyday....

So, should I fill I-130, or not?

Appreciate the help!

If you are adjusting from K-3 visa, you need (at least) the notice of
action for the I-130. You can also use the notice of approval of I-130.
If you are adjusting from fiance visa, you do not need an I-130 at all.
If you are adjusting from any other visa type other than K-1 or K-3, you
need to also file I-130 at the same time as AOS is filed.

It just sucks that I have one more form to fill and more money to spend....
