All the evidence was missing. He sent it in after receiving the RFE. He sent in the decree and the absolute.

I'm going to hazard a guess that if they hadn't even cashed your check then something pretty evident and material was not submitted and that your husband probably didn't submit "everything." I would suggest to first check and double check what you both submitted and then if you still can't figure it out to seek the advice of a professional.

And like a previous poster noted, please don't go to a "visa consultant" or "notario" or an "immigration specialist." 99.99% of them are fraudsters. If you're going to lay money down for something this important in your lives then it's best to seek out the advice of a reputable immigration attorney.

Rene: Thank you. My fiancee has written to the USCIS asking for a reason why we have been rejected, hopefully he will get a reply from that or at least the reason why when they return his money. I am so depressed with the thought of being apart for yet another year and would welcome any help.

I am sure that they did cash the cheque. It was after he sent in the missing evidence that it was rejected. I am going to Court today to check my divorce papers are the correct ones just in case it was those which were wrong. Hopefully the USCIS will explain what was wrong when they send his money back. We have taken everybody's advise and deleted the visa help sites we had saved and he is going to use an emigration attorney. Any recommendations would be welcome.
