Default How long is the K1 valid for?

Hi all!

As you all know Jan and I were very fortunate to have gotten our
approval on 12/23, only 13 days after the first NOA.

I understand that he has until 4/23/03 to present his paperwork to the
consulate and then he will be given an interview date. Hopefully at that
interview his K1 visa will be granted.

Unlike many people on this board, we are taking the seemingly odd option
of stretching this out. There are many reasons for this. First of all,
dur to Jan's work situation, he can't even consider leaving Germany
until his current project is scheduled to end on 6/15/03. And there are
many more reasons, including, WE SET A WEDDING DATE! YAAAAAAAY!!

My question is, how long is the K1 visa valid for after it is issued?
Ideally, Jan would enter the US with his K1 in late September to
mid-October. That gives us enough time to arrange the move, for him to
get settled before the wedding, and enough time to complete the AOS
application process within the required 90 days.

Will those of you with more experience please share if you think this
timeline is workable?

Hi,

Once the K1 is issued you have 6 months before it expires and can enter the US any one time within that period and marry.

The day you enter the US on your visa you have 90 days in which to marry.

The thing I think you need to watch out for is that the 129F notice of approval is only valid for 4 months and it needs to be valid on the day of your interview. The embassy can extend the life of the NOA at its own discretion so you might want to contact your embassy about that if you want to draw out the process. From your post you seem to think the NOA needs only to be valid when you present your paperwork, which I assume refers to Packet 3. You should bear in mind it also needs to be still valid on the day of interview.

There are diferent timeframes with different consulates so you might want to check how long it is likely to be from your sending in Packet 3 to an interview date and see whether you need to apply for an extension of the approval notice. I believe the US petitioner needs to write such a request to the embassy concerned. Do bear in mind it's at their discretion. Some consulates are more helpful than others. I would suggest more research to make sure you are not risking having to start the process over again with all the attendant costs.

In my passport I still have the K1-visa. Issued in 2000, if
nothing has changed since then it is valid for 6 months.

After arrival you need to get married in 3 months.

If he gets his visa March 31 (better play safe), he needs to
use it ultimate November 31 and get married to you before
end of February 2004.

So your schedule is fine. Looking at the wedding date: let
him not come over before August 2 or 3, because of the three
months period. The AOS procedure really starts *after* your
marriage. Before that not much happens, except for having
fun together, try to get a SSN and an EAD and a Drivers
License. Which seems not that easy in these days.

The 90 days you are speeking about is probably the 90 days
within you have to marry after entering on a K-1 visa.
Otherwise the visa is void and he will be illegal.

After the marriage, get a Marriage Certificate of course,
file the AOS and wait.................I did this in
September 2000, still no Greencard.
