How long to file AOS
 
My finacee and her son recieved their K-1 and K-2 on May 15, 2002. We were married on
June 15, 2002. Because of work and a new family and everything else I have not had
time to prepare their AOS package. Cany anyone tell me how much time I have to file
this??? Their Visas are stamped for November 15, 2002......is this how much time I
have to file?? Thanks in advance.

When i called the INS and asked them the same question relating to my K1 Visa, I was told that there is no time limit and that I could take as long as I liked.

Unfortunately, no is the answer to that one. You have 90 days from when they arrived
in the USA using their K1 and K2 visas. If you go past that date without filing for
AOS you are technically out of status and it could cause problems. Plenty of people
have filed for AOS after the 90 days and not had any problems but there is always a
risk. I would get it done as soon as possible if I were you.

If you entered into the marriage within 90 days, you could file AOS anytime. Check
