Not quite.
An IMB must do certain checks on the background of USCs using their service before giving a foreign national's contact information to the USC. Clearly this background check will occur irrespective of whether or not there will eventually be a K visa application, and
Any USC who files an I-129f petition must disclose certain criminal background information to USCIS, which will pass the information on to DoS, which will confirm that the visa applicant is aware of the information in the course of the visa interview.

The USC is background checked when applying for a K1 visa but only if they went through a marriage broker or agency...

Repeat earlier observation: The movie "War Of The Roses" was a comedy.
New observation directed at others at others: A good family lawyer needs to be assertive. That is not the same as "mean [and] vicious."

A mean and vicious counsel may not be able to deliver successful litigation in favor of the poster. When 2 mad bulls collide little flies get killed.
An assertive fellow could get in some mean and vicious results for the rogue ex, and a clean divorce for the OP.

The source that you yourself referenced tells us the IMBRA establishes a number of requirements, not all of which are associated the use of an IMB.

That might be true but on the I-129F it asks if you met through a dating agency or marriage broker. Why would it ask you that if they were doing a check anyway? There has to be some significance to that question. As I understand it, IMBRA law was specifically targeted at marriage brokers and agencies not individual personal contact. Maybe Mr. F can shed some light?

I'd make a visit to the local police department to get help and protection to go to the house and collect your possessions including vehicles in your name only, you could sell the cars to pay the divorce lawyer

I was only allowed to go to the house once with the sheriffs. He had packed my stuff up into 4 boxes, the judge asked me if that was ok, and I said I wanted to see what was left in the house (the Sherif is supposed to do a walk through with me). There was more stuff still in the house than he had packed - I guess he thought I was playing! He did not let me take several items and I could not challenge him on it.
I was in a shelter for 2 months, so it was the end of December/January before I realized that things were missing. I returned to court once for a contempt hearing when did not turn over some of my jewelry. That did not go very well, he played the fool and the judge bought it. Although he was ordered to return duplicate car key for my honda and a ring, or jail time.
I was told to wait for the divorce to get big stuff, like my treadmill, but he's listing it as my debt, but no mention that it is in his possession.
I'm going to see a lawyer tomorrow, so let's see what he advises. I'm not going to loose any sleep over it. I've come too far for that Besides....I was a fool to get involved with him, and he's not worth anymore of my time than is necessary to get this mess sorted out.

Beginning to feel like a comedy of errors to me! I remember that movie now - I really don't need all that drama and negative energy. From what I remember nobody won!
