HELP !! MOTHER & 7 YR. OLD CHILD SEPERATED FOR 2 YEARS

Hi Group,
I have petitioned (I-130) for my stepchild who is 7 yrs. old almost 24
months ago a . The problem is: The child is living with the father
(who is currently on death bed) who no longer is in a position to take
care of him. Our son is very dispondent, he isn't even functioning
well at school because he is unhappy and probably thinks we have
abandoned him. We also heard that he is not being treated well by the
people around him........we are going crazy.
He also has a health problem which must be monitored, but we are not
sure that it is being done. When we send the money to help with
medical, they use it for something else, so the child is left
untreated.
Is there any other way we can have the child here without waiting for
the petition to approve? We spoke to an INS rep who states that it is
now taking up to 999 days for that kind of petition to be approved.
We are frustrated and don't know what to do. My wife is thinking of
quitting her job and go back home because of this (which i do not
approve of). I consider getting him a visitors visa to come here, but
i also heard that it would not be granted because he will be
considered as an intending immigrant.
Please help us. Any suggestion/help will be appreciated.

Look up the expedite criteria for the Service Centers and see if you can make a good faith argument for an expedite in the boy’s case. I’ve posted this criteria a few times now, and if you search under the terms, “VSC expedite criteria� you will probably find an old posting of mine where I posted that information. You can also probably find it by visiting some of the service center websites.

What country?
Is there a possibility of filing I-130 directly there.
You should get in touch with the consulate there.
I didn't realize an I-130 for a child took so long.
I thought it would take about the same length of time as a spouse, since
they are both "immediate" relative petitions not subject to a cap.

Jamaica, and I filed the I-130 at the Texas Service Centre.

I wasn't referring to whether or not you could normally file DCF there,
just to determine if the consulate could assist in getting the child a
visa.

I believe that the expedite fax no for TSC is (214) 489-4021... please check that as it could be out-of-date.
I also faxed my congressional aide this evening. I have dealt with her before as she eventually had my daughter's I-130 expedited through CSC. Be polite, be persistent, IMHO you have a very real reason to require an expedite. I will call her tomorrow....
Poor Deanna will probably run away screaming when she see my fax only to remember that that doesn't get rid of me either.....

Is there a possibility of filing I-130 directly there.
You should get in touch with the consulate there.

I was shocked.
Also, I'm sure it was MU who posted a while ago that step-child nd orphan cases can be considered "higher grade" work than many other immediate relative categories - thus they may be given to a more senior adjudicator and perhaps take a little longer?

Sorry for the misunderstanding. Anyway, if you are refering to a
regular visa (b2/1), they usually don't because the child is
considered an intending immigrant (because the parents are in the
U.S.) so they usually advise you to go through normal procedure (which
is what I think I am doing). I am not sure if they will make an
exception in this case considering the circumstance, but nothing beats
a trial than a failure, so i'll be contacting them.

I wouldn't waste too much time with the embassy at this point. I would focus on getting the petition approved then work with Kingston. I agree that they are not likely to issue a visitor visa.

Please do keep us posted. Worse case I'll probably wait until next Monday and then send the I-130 with expedite request anyhoo. I'm not mailing it on friday as CSC recieve 40% of their mail on mondays...lol
