Default help immigrate to US by marriage

Am a zambian male ,I've been married for 1 yr 1month to , US citizen in Zambia who
has not been to US since 2yrs old , now 25. I was there last year on J1 visa, when
she visted the US embassy in zambia she was told , she would have to leave first then
file a petition in the US. we have enough money saved to relocate and settle before
she gets a job. Is there a chance we might be able to leave together ? How can she
file a petition in zambia? can our savings be declared on the I-130? can I get any
other Visa to travel with her?

It would be much quicker if she filed in the US. All those Embassies do is forward it
to the US (and much slower than the regular post.

1. She can file an I-130 petition for you directly at the consulate in Zambia if she
is a resident, see this URL from the Zambian consulate:

2. The hangup may end up being money: she also has to file an I-864 affidavit of
support for you. The minimum amount of savings that you would have to have for
this would be 5 times 125% of the annual poverty line. This would be somewhere in
the neighborhood of $75,000 if assets are used. However, she is allowed to instead
use a co-sponsor in the US, either citizen or resident of US, who has adequate
income to meet the requirements for his/her own household and you, put together.
3. She would have to have a residence and bank account in the US in order to file the
I-130 for you EVEN IF she uses a co-sponsor for the affidavit of support. Read
from the INS website on the affidavit of support here:

4. Find more info at the I-130 help-site here:

"DCF:Which Visa" section of the Doc Steen site.
5. African consulates seem to traditionally be very hard-nosed about granting any
kind of visa. Be prepared for that. You may want to seek the counsel of an
attorney to assist you, if you can afford it. Alvena

Not corect if DCF is possible
