Help- green card holder wanting a divorce, husband fraud..

Default Help- green card holder wanting a divorce, husband fraud..

Hi!
I got married in jan 2001 to a US based guy who had already adjusted
his status at the time of our marriage. I finally got through the
immigration in june 2002 & received my permanent resident card which
expires after10 years, Category E34.[ I was in india till june 2002
during which period of time, my husband had visited me for 3 months
from oct 2001 to jan 2002.]
I discovered after i landed in the USA, that my husband had lied to
me about his job, salary. assets etc & also he started demanding money
from my parents. He never got me any credit cards nor did he open a
joint bank account in my name saying that my parents should send the
money to his bank account. All the phone calls were screened & i was
not allowed to make any phone calls from the house. Then his parents
came to the USA & started living with us & they started abusing me.
One day, without telling anyone, i just picked up my suitcase & left
to India. I had the return ticket given to me by my parents.
Now my husband is threatening to divorce me & says that my green card
will be taken away & if i ever enter the US again, i will be deported.
My husband also files taxes in 2 countries, USA & Canada Showing that
he is employed in both the countries. Is this legal? He is also
involved in many fraudulent schemes, but i have no proof of any of
these as i left in a hurry when i had the opportunity.
Can he do that? Am extremely worried. Please help me.

Hi Anna:

First, a question -- what do you want? You are not clear on this.

Second -- the classification under which you got your green card indicates that he completed adjustment AFTER you got married. It may be that he was here in some other status, probly H-1B, and traveled to India to marry you. This is a fairly common pattern.

Third -- I don't know what really happend in your marriage other than it didn't work out. I've learned that the emotions involved often cloud perception of what happend. [Note I'm NOT accusing you of lying -- I'm not in any position to make any such judgemnt]. But, assuming what you say is true, any threats by him to have you excluded would also involve danger to HIM.

I recommend that you make a paid consulation with a US immigration attorney. There are seveal that make periodic trips to India. Or they can be arranged over the net.

I want a divorce or legal separation.. whatever... just want to get on
with my life. I would prefer to continue to live in the USA as life in
India would be tough for me as a divorcee. I would study again & get a
job.

Can he get my green card revoked & deported from the USA if i do come
back to the USA?

Can you suggest any good lawyer in India? I have heard that lawyers in
the USA are very expensive.

I want to know what will happen to my green card if i get a divorce?
I am right now in India. Will this affect my green card?
I plan to come back in Jan 2003. Will i be allowed to re enter the
USA? It s been abt a month since i left the USA. I lived in the US for
abt 2 & 1/2 months.
Can he get me deported by withdrawuing the financial support letter as
this is what he is threatening. How can i come to know if he has
already done that? Is there any way i can know the status of my green
card from India?
I'd really appreciate any replies to these questions.

I have a similar problem.
I was told by an immigration investigator:

1. Once the immigrant receives the Green Card it is almost impossible to
remove the immigrant from the U.S.

2. If you have the "permanent resident" card in your possession there
should be no prblem returning to the U.S.

3. INS and their investigators have more important matters. This was
from my meeting with the investigator here in Dallas, Texas.
