Default Help: Can k1 visa be extended.

Hope somebody can help me. My fiance already got her k1 visa in Lagos,
Nigeria. But due to circumstances, she won't be able to come over
until about 2 months after the visa expires. The embassy said they
can't extend the visa, is that true and if so, what are my options.

Agsoba,

I would think that the embassy is the authority on the subject - they issued the visa.

Your option is to start over so she can apply for another visa.

1. File I-129F again
2. Get married, file I-130.
3. Ask an attorney if there other options.

K-1 is valid for 6 months. Would it be possible for her to come over
within the 6 months, get married, get AP, then go back and tie up
whatever needs finishing in Nigeria? You really don't want to go
through this whole thing again, do you??

My fiance was not able to use her original visa either. All we had to do
was resubmit all the papers to the consulate and they gave her a new visa
with no problems. They did question why she did not use the original, and
if she really planned to come to the US. This was last November in Bangkok.

We're talking about the U.S. Embassy on V.I., right? They won't extend no visa for no reason whatsoever, so you have little choice but to bring her here on the original visa - or - as was suggested before, file again for the I-129F and go through the exact same hassle. (I shudder to think that!)

Surely, there must be SOME way in which she can come before the expiration date. Can she conduct her family/personal business before the expiry date?

The visa is good for 6mths. Do you mean to say that she cannot make one trip to the US, fulfill the 90day requirement, then go back to finish what needs to be done Nigeria?
6months is a long time and i cant fathom what on earth could be so crucial that it can't be given a break and be reconvened when she travels back. Personally, after dealing with this whole process i'd not be so keen to start all over again, delaying being with my loved one any longer. But hey, that's just me.

Wouldn't this bring up problems with advance parole and getting back in?

Hmmm. yeah i suppose it would. but again doesn't it depend on if the circumstance is so excruciating that one needs to request AP. I thought that's what Ap was for anyway, emergencies. Correct me if i'm wrong.

It is for emergent reasons, but different offices have different timelines for issuing it. Even if the OP had posted which District Office they would be using, past experience may not be a good guage. Many offices have now started farming AP and EAD applications out to the NBC.

I think the VI stands for the Victoria Island where the embassy is located.

Well, the reason why she had to go back was bcos she has to go finish
school. We thought school will be done in december, but thanks to the
constant srikes in nigerian colleges, she won't be done until June.
Anyway, she did come in on January, we got married, filed for AOS and
AP at the miami office, which was a mute case anyway, 'cos she had to
leave and go finish school.
She has gone back and i've started the process for a k3. So now, it's
waiting for the whole process again. I'm just praying that the
interview in lagos for the k3 will be as smoth as the interview for
the k1.
For the k1, they basically asked no ?. she said the officer looked at
all the documentation she had, asked her if we were married.
One other fact that helped at the embassy was the fact that she went
there with our daughter who was two months old at the time, and they
were also both at the embassy about two days before to apply for U.S
passport for our daughter and fortunately for her the officer who
interviewed her was one of the officers playing with the baby when
they were at the American citizens section.
One thing that now worries me though is the fact that we just did a
registry wedding at the courthouse with no fanfare and no pictures and
i'm praying they wont usee it against her not having pictures.

what is OP? I'm familiar with most of the acronyms and lingo we as K1ers use, but this is a new one for me.
