Hawaiian honeymoon with out-of-status visa?

Default Hawaiian honeymoon with out-of-status visa?

I'm a US Citizen and my girlfriend is currently out-of-status and has
been out-of-status for about 5 years now. We will be getting married
in September of this year and I would like to know if it is possible
for us to travel to Hawaii for our honeymoon?

It's "possible" because Hawaii is part of the USA. However, it's "risky" because if anything happens to the plane and it needs to make an emergency landing outside the USA, your gf will not be able to re-enter the USA. I personally wouldn't risk it. Save that trip for when she has her GC in hand.

why would you want to wait another 4 months if she is out of status?

Why not? Hawaii is one of the 50 states (as you should know as US citizen), and
flights to Hawaii are therefore domestic and are no different than flights to
NYC or San Francisco or LA or...

What if it has to be rerouted due to an engine problem and lands in Vancouver? Canada is a foreign country. What if after landing the plane cannot be repaired quickly and there is no other plane available until the next day and you have to leave the airport?

I'm with Joe, if the plain has engine problems immigration status
would be the last thing on my mind.

the fear of us plunging to our deaths in the middle of the
ocean...lol.

Right, I know that Hawaii is one of the 50 states so it's the same as
me traveling to Florida. But that also means she still needs to show
some kind of identification to the airline. The problem is the only ID
she currently has is a renewed passport from her country.

I guess my question now is, is there anyone from the airlines that
would be looking for a missing or expired visa on foreign passports?

I read a post that seemed to suggest that USCIS (INS) uses airlines to
help find people who maybe here illegally. Is there any truth to this?

Has anyone been sent back home for traveling in the US with an expired
visa?

Relax - all they're interested in is the bio page. In fact just a valid drivers license will be fine.

Though why you would want to wait rather than get married now and file for her AOS really puzzles me. If she were to be stopped by a cop for a traffic violation or accident they would definitely check her immigration status.

At that moment, yes. However, I'll bet her lack of immigration status would be the first thing on your mind when you try to return to the USA and find out you have to come back home without her and start her process from scratch, perhaps with a 10-year ban from returning to the USA in place.

But that also means she still needs to show
some kind of identification to the airline. The problem is the only ID
she currently has is a renewed passport from her country.
That will be fine for her to show as ID to board a domestic flight. They won't be looking for a visa in her passport on a domestic flight.

Yeah, that's a much bigger risk than any far-fetched airplane engine problem...

Sorry I'm unable to reply to your replies faster. I appreciate
everyone's comments we've all been a great help.

Waiting to file for here AOS after getting married is definitely an
option. But if we have the ability to go straight from our wedding to
a romantic honeymoon in Hawaii as appose to heading back to our
apartment in Queens (not very romantic) that would be great.

It's up to you if you want to risk it. Personally, I'd rather have the security of lowering the risk of being stranded outside the USA with a ban in place, rather than a romantic getaway right after the wedding. There are lots of romantic seaside places within the continental USA, without going to Hawaii. Maybe you can do Hawaii on your 1-year wedding anniversary instead. But, of course, the choice is yours.
