Has anyone ACTUALLY proved extreme hardship please???
 

Hi all,
I know that I will prob have to prove extreme hardship for my husband to get my K3..I have searched all over the net for any sucessful cases but I only ever come across refusals by INS on cases a few years ago where there were usually other criminal problems involved.
Has anyone actually been successful?..I really need some hope right now..

Actually, I have read several success stories in this group. Try
searching the archives of this newsgroup.

Hi, why do u need to prove extreme hardship? Is it becuz of a cimre or any other reason that he wouldnt get the K3 under normal circumstances?
im asking cuz I might be in a similar situation, although my lawyer siad , if my husband is refused a k3, then we can apply for a waiver.

Hi Ticket,, you have been really helpful with my other posts. I have searched for ...waiver, 212, hardship etc but have found nothing.
I have to apply due to a previous overstay...WE have proof that we contacted several 'immigration specialists' who gave us the wrong advice.
We are desperate for help.
My will to go on is at an all time low.

hi julie. i might have to apply for a waiver for my husband since he did have a technical "overstay" on his HIb becuz he didnt work for the that particular company. but there is no stamp on his passport that says so. lawyers all say different things i am so confused :(
but i do know that u have to first be rejected for a k3 to go on an apply for a waiver.

i konw ,..andd its hell
 

so sorry ..i know how it feels..i was sorry it happened and i tried to get advice...but no one wants to know .....you are sorry and you had problems....just need help/but people judge you.

If you do to this site and look in the "criminal record" link, it will
give you the basics on filing a waiver and some exammples
ofjustifications for the waiver. Getting wrong advice in the past will
not excuse what may have happened as a result, unfortunately.

Hi:

Although some people have gotten approvals by themselves, this is one area of law that is pretty complicated. INS doesn't understand it.

I would recommed strongly that you spring for an attorney -- one who has epxerience in getting these waivers granted.

Have you been denied already or are you preparing for denial?

We need to prepare the same waiver (if we're denied this week) due to an overstay as well....
Best advice I've gotten is to get a lawyer to prepare it.
We will....worst case scenario.

In being able to "afford" things, there is often more than money involved. What is the "cost" of not being able to live together stateside?

I've mentioned that I have nothing against people "doing it yourself" -- reasonable research can asnwer most questions.

However, this is an area no ameanable to a layperson. And the laypeople who screw it up the most are INS officers! They have to be gently, but firmly taught the correct law.
