Business and Tourist visa applicants are required to demonstrate their
ties to India. Such evidence is necessary because American law does
not allow the issuance of a nonimmigrant visa to people who may be

So hyper she does not intend to go back per the post.. so I think that
shall be in violation in the intent of the non-immigrant
visa..deduction is fraud as it is circumventing the orginal intent..

She is Spanish, she can stay up to 90 days in the states without a visa, VWP.. ,plus she doesn't intent to stay, the OP wants his wife to be able to visit while the DCF is pending
