Default Getting married with Immigrant Visa

Hi all,

I have a simple question for all you experts. If someone gets an immigrant visa on F2B category (Derivative Beneficiary) and then marry someone before coming to USA, can it cause any problem at POE?
As always, will appreciate your response.

I didn't look it up, but if F2B is an UNmarried child, then if they marry their category will change. They will fall into a different processing time in that case.

If you get married after you get the visa (and before you become a PR) then your visa is no longer valid. It may well be that the officer at the POE will not spot it, but you could have serious trouble later on.

What is it that you don't understand.

The visa is for an unmarried person. The visa is not activated until the person enters the US on that visa. If the person marries before entering the visa is void.

Please stop being an immigration expert for your friends and family.

How could they not spot it. The spouse will be traveling with the visaholder since from most of the Middle East you can't enter without a tourist visa and they are hard to come by.

Hi:

By definition, the FB-2B, both as principle and derivative, requires that the visa holder be UNmarried at time of ADMISSION. And even if the person gets past the POE, they can be removed later as having been admitted without a valid visa. And even if they get naturalized, it can be taken away since they initially did not have a valid visa.

Hi:

So? By the way, the consulate give a WARNING not to get married before she immigrates. In fact, many consulates make the applicant SIGN the warning so they can't later claim "I did not know."

Further BTW, this happens not infrequently and the resulting mess is often sad to see.

What if someone gets married, then realizes his mistake and gets a quick divorce before traveling to the US? Would he be able to use his immigrant visa then?
