Hello!

I'm 27yrs asian man and my partner is 48 yrs US citizenship. We live in San
Francisco.

we are finding the lesbian couple who are in simular situation. we can help each

Very helpful. I think they know this. So, I guess you are going to be first to write
to your congressman demanding they enact a marriage law that applies to homosexuals.

Charming little piece of work, aren't you? Oddly, despite being judged inadequate by
such a well-spoken person as yourself, the original poster was easy enough to read
that you still understood his meaning.

Indeed, I can't imagine that any member of a long-distance same-sex couple could not
be *painfully* aware of their being forced to sit and wait interminably while
heterosexual couples partake of their privilege, remaining all the while blissfully
ignorant of the law.

Of course it is fraud. Unfortunately, the law, while not the sole arbiter of
morality, is utterly unjust in this regard.

As a bisexual man, it is incredibly galling to me to think that if I had fallen
in love with another man, the avenue currently open to me by law would be utterly
closed, leaving me to fend for myself through either the Diversity Visa Lottery
or a H1-B.

To be stuck a world away from my lover by systemic bureaucratic homophobia would be
intolerable. Who here doesn't know the pain of not being able to communicate properly
with their loved one? Who doesn't know what it's like to have to leave the country
and say cheap and unfulfilling goodbyes in airports departure lounges? I am not at
all surprised that arrangements like this spring up when loving couples are driven to
them out of utter desperation and worry.

This is what I plan to start doing as soon as I am a conditional permanent resident
(ie someone that a congressional representative would spend more than a few minutes
bothering with).

Does anyone here know of volunteer groups working to have the law changed in this
regard? As I understand it, a repeal of the Defense of Marriage Act would be required
at the very least, so change will not come soon.

I say we change the law around for say 5 years such that hetrosexual couples are not
allowed the privilege and only homosexual couples are allowed. Then come back here to
see whether you and the group still thinks the same way. I think if that were to
happen you'd see this guys point.

I don't care what he is. But fraud is fraud. Marriages of conveniences happen all the
time, sometimes as a manner of getting into the US-- which is fraud all the same.

I have to applaud both Andrew and Jason for their liberal thinking and their willingness to post a view not often see favorably.

Until the federal government recognizes same sex marriages as legal, there is not a snowball's chance in hell that INS is going to do so either. And that sucks really. Love and commitment to another is not restricted to hetero-relationships.

What they are proposing is fraud, plain and simple. Perhaps they would have been better to post in a gay oriented NG where they would be more apt to met others of same like. Then they could proceed with their lives in a way that brings happiness to all parties without advertising publicly their need to commit fraud.

As for INS, they don't know what goes on behind closed doors. There should be some areas of life that can remain private from Big Brother's eyes.

Unfortunate for some though, there's now more clamping down. Especially on vistor's
and student visas.

The only fraud I see is a government that prides itself on the principle that all
people are created equal, but consistently and cruelly chooses to not live up to
that standard.

That is fraud and deception of the first order, and it is intolerable.

Australia recognises same-sex relationships for immigration purposes. It's not
marriage and it's not perfect (hah, our immigration process is easily the equal of
the INS) but in that respect at least it is worthy of admiration.

In any event, this is getting regrettably off-topic. Further missives will be

Are these laws and regulations to be followed as is regardless of what they say or are they to be fought and changed? A marriage of convenience may be an easy way out (if you can pull it off) but perhaps they got nowhere with their Congressperson and they don't know what else to do?
It seems to me it'd be awfully difficult for the INS and Congress to change this regulation what with the mostly Christian basis for the law, the moral turpitude questions on the I-94, etc. You'd have to have separation of Congress's "morals" from their subjective view of a married couple and allow for a completely objective view simply of a couple in love with each other regardless of their gender.

Some states do, but it's not recognized at the federal level.
