I hope someone has experience with this situation. My fiancee (marriage in one week)
was placed in hearings last week because my father called INS. to check on his
status. ( he overstayed more then 180 days). This is a true "Meet the Parents". My
father was in law enforcement and "knows people". Now my father feels bad due to the
situation we are in. My brother is an attorney, but has nenever dealt with this.
Should I still file the i-130 after the ceremony and then apply for an adjustment of
status as part of the removal hearing? We can prove that our wedding was planned
prior to this happening. I really do not want to move to another country.

You have a father who was formerly in law enforcement who knows people and he deliberately put your future happiness in jeopardy? Hmmmmm
Well get your brother the attorney to find you a good immigration attorney who specializes in removal proceedings and pay the money for his advice and/or help in clearing up this situation.
One thing you don't want to prove is that you were planning this wedding before the fiancee stepped across the border.

You are recommended to visit an immigration attorney as soon as possible to see where
you stand. You do not need a general attorney, you need someone who specializes in
immigration law. Alvena

I am not a lawyer and this is not immigration advice. This is my personal opinion,
gleaned from the previous postings of others, and posted for the purpose of
discussion only. If your case is complicated, then you may need an immigration
attorney. Locate an immigration attorney in your area at: http://www.aila.org
