Fortnight away from activating my K-1
Forum members,
I finally got my holidays approved. I had saved up 8 weeks (been with
my employer for 5 years) and thus I am not resigning before moving
down to the US. I intend to go down, activiate my K-1, get married,
file AOS, go for our Aus+Nzl+Hawaii honeymoon, come back to the US and
then return to Canada for two weeks so that I can give notice and
resign.
Now I have a few questions. However I need to present the plan first.
I had mentioned in my last post that Saba has a job offer to work for
her new employer from any major city in EST zone. We have decided on
Detroit for reasons mentioned in my last post. This is what I have in
mind.
Cross into the US at 1000 Islands. Saba and I have decided to have
our civil ceremony in Watertown, NY. My folks from Toronto, an
uncle/aunt from Elmira, NY and Saba's folks from PA will more or less
have the same driving distance. With certified copies of our marriage
certificate in hand, Saba and I will then make our way to Detroit. My
cousin (whose wedding anniversary prompted me to make my last US
entry) has offered us his place to crash until we find a place of our
own. Saba and I prefer to hunt for our place once we return from our
"downunder" trip. So basically we will be at my cousin's place a
week, 10 days tops. However I intend to apply for AOS during that
week itself.
Here are my questions:-
(1) Will the 1000 Islands POE officer give me grief when I supply him
with a Michigan address? He/she will probably want to know why I am
not using Windsor or Sarnia to cross over.
(2) My folks, siblings and I will be crossing into the US in the same
car. Will customs have a problem believing that I am not importing
the car into the US and that my folks and siblings will take the car
back to Canada with them after the civil ceremony?
(3) Will Detroit INS have issues with us producing a NY marriage
certificate and not a MI one seeing that our "very new" permanent
address in in MI?
(4) If questioned for lease or rental papers, I will truthfully tell
the officer that we are staying with my cousin for the time being.
Will that cause us any grief?
(5) Regarding Saba's I-864, she made 60-70K in 1999&2000 and 108K in
2001. However regarding current employment, she will have her last
pay stub from her ex-employers in NYC (her last day there will be a
day before we all meet up in Watertown) plus an employment letter from
the new employers but no pay stubs. She will be making 120K but her
start date will be a week or so old only. Will that prompt the INS
officer to give us grief?
I personally do not forsee any of these as show-stoppers but one can
never be sure with INS.
