My situation: I'm a mother holding a green card living in the United States. I have a 26 year old son living abroad, who I wish to petition for a green card.

Question:

Part C, #2 (Address): Is this my son's current address abroad?

Part C, #19 (Your relative's address abroad): Is this my son's current address abroad as well? It seems redundant to #2.

Part C, #9 (US social security number, if any): My son does have a ss number from when he was studying in the US, but he doesn't remember it and the card is stowed away in another country, thus not accessible right now. Do I write N/A, none, or just leave it blank?

Just to be sure, your son is unmarried, correct? And you are not petitioning him for a green card...you are filing a petition to establish your relationship to him, so that he can then apply for an Immigrant Visa.

Yes.

Yes. Keep in mind that the I-130 form applies to lots of different relative categories. Sometimes the beneficiary might currently have an address in the USA, as well as having a permanent residence abroad.

Don't put N/A, because the question IS applicable. Don't put "none", because he DOES have a SSN. Either draw a straight line through that space, or better yet, put "see attached", and then on a separate sheet of paper, reference the form name and question number, and write a detailed answer as you have done above.

Thanks a lot. To clarify, I am the mother living in the USA. My son lives abroad and is unmarried. His SS card is in country A (our country of citizenship), but he now is studying for his masters in country B, so hence the card is not obtainable currently.

Since he'll return to country A next year after graduation, do I need to mention his current address at country B (Part C. #2 address)? How do they determine which country he'll get his interview in? I don't want to mess up and have USCIS designate country B for his interview, since he's just studying there temporarily. For #19 I'm putting down our country A address, if that's correct.

For these two questions, I would also say "see attached", and then describe the situation. i.e., permanent address...Country A. Currently studying at address in Country B. Plans to return to Country A on xxx date. Plans to attend immigrant visa interview in Country A.

How do they determine which country he'll get his interview in?
See Question 22 (where it says City, Country).

Some helpful hints: Take each question at face value. Do not ascribe any meaning to a question beyond what is plainly written. Do not try to twist the question to fit your circumstances.

If you are filling out the questions today, complete it with today's information... not with information that's going to take place a year from now.

Here's the question to ask yourself... is your son, in fact, living in another country or is he residing there temporarily? Once you know the answer to that, the rest becomes easy.

For Part A. # 10 (Alien Registration Number), is that my green card number?
For Part B. #10 (Alien Registration Number), I write none because my son isn't in the US right?

There's no such thing as a "green card number". They are asking for your Alient Registration Number, which is an 8 or 9 digit number which looks like A-xxxxxxxx.

No, just because your son isn't currently in the USA doesn't mean he has no Alien Registration Number. You say he was here in the USA before, as a student...perhaps he does have an A- number. Did you ask him? (I don't know if students get an A- number assigned or not...perhaps not...but you should ask him to make sure...sometimes people who have a record of being in the USA, do have an A-number.)

My son was on a student visa, so I think all he had was a I94. Isn't alien registration number specifically mean the green card A number?

He might have had an A# also.


Isn't alien registration number specifically mean the green card A number?
No. I had an A# for many years before I ever had a green card.

in your experience, if a foreign student were to apply for a student visa to purely study in the United States, then leave after graduation, would he have a A number? My son went to school in the US around 2001. It's so long ago and I'm not sure he remembers. Thanks.

I never had a student visa. Why not just ask your son?


My son went to school in the US around 2001. It's so long ago and I'm not sure he remembers.
Then he should look in his prior passports! If he has an A#, it'll be on his visa or I-94. I had an A# in 1998... and to this day, I remember that I had one. It was on all the correspondence I received from the US government.

Perhaps.

As Ian said, ask your son and have him check his records. If he DOES have an A-number, you should list it on the I-130...it will avoid them issuing a 2nd A-number...they can just keep using the same A-number, and it will be much easier than trying to combine 2 numbers (2 files) later.
