Form I-129F Help

Hello!

I've scrolled through the forums a little bit and cant seem to find the answers i'm looking for - my apologies if i didn't scroll far enough.

I am a UK citizen, i recently got engaged to my Fiancé who is a US citizen. We have decided that the K-1 is the route for us.

From my understanding so far, the first step is to file the form I-129F petition along with the evidence required. There are just a few things about the form that are a little bit complicated to me.

Firstly, i worked at a summer camp on a J-1 (2014-2017) and because of this i have a social security number - do i write that on the form even though i am not a US citien? (im assuming the answer is yes but i wanted to double check)

Secondly, my partner (who will be sponsoring me) has a criminal record. we have ticked yes to the question "Have you ever been subject to a temporary or permanent restraining order (either civil or criminal)?" and then for the following 3 questions we have ticked no. We have also ticked yes to question 4.a. "Have you ever been arrested, cited, charged, indicted, convicted, fined or imprisoned for breaking or violating any law or ordinance in any country, excluding traffic violations (unless a traffic violation was alcohol- or drug- related or involved a fine of $500 or more)?". He was indicted on an aggravated assault charge in 2009 when he was 19. And do we have to attach his criminal record? i can only see that we need to attach that as evidence when answering yes to the other crimes mentioned on the form.

Thirdly, there is a section in part 3 called 'Multiple Filer Waiver Request Information'. I have ticked box 5.d. - "Not applicable, beneficiary is my spouse or i am not a multiple filer". I am not sure if that is right considering my Fiancés history (the other two options talk about being a multiple filer, having a prior restraining order, extraordinary circumstances etc - i think ive ticked the correct one but ive been looking at this question so long it no longer makes sense!)

For question 53 (have you met in person) we have filled out a statement in the space for 54 and then continued it on section 8 additional info. Do i need to say that it is continued in section 8? and what is this description supposed to look like? My partner wrote the following: "I met my Fiancee working at Appel Farm Arts Camp in 06/26. In the past 2 years, my Fiancee returned to the summer camp for 4 months, during which period we spent our days off together. I then visited her in the UK in Oct 2017 for 2 weeks where we travelled together. My Fiancee then visited me over Christmas 2017 and then again in summer 2018 where we took trips together. In October 2018 i returned to visit her and travel. She most recently visited me over New years into March." - is that correct?

I also have a question about work history (i'm sorry i have a million questions). Every summer from 2014 to 2017 i worked at a summer camp. obviously that work is seasonal so i returned home every year. There isn't really an option to explain this, so i have written it as 2014-2017, and in brackets put 'seasonal'. Do they need more of an explanation than that?

Lastly, i posted questions about this visa around a year ago (i had a friend that got engaged and hired a lawyer for this) and almost everyone that commented said they didn't get a lawyer/there is no need. Is that really true? I feel like there is so much room for mistakes and i'm worried about having to file it again and lose money. Plus i'm worried about his criminal record, but i wasn't sure how necessary a lawyer is for his past.

Thanks in advance/sorry if these questions have been answered!

1) Yes, add your SSN.

2) The instructions state: "If you were ever arrested or convicted of any of the specified crimes, you must submit certified copies of all court and police records showing the charges and disposition for every arrest or conviction. You must do so even if your records were sealed, expunged, or otherwise cleared, and regardless of whether anyone, including a judge, law enforcement officer, or attorney, informed you that you no longer have a criminal record." The "specific crimes" are listed on pg. 6 of the instructions: https://www.uscis.gov/sites/default/...-129finstr.pdf.

3) Has your partner filed the I-129F for anyone else previously? If the answer is no, then your chosen box 5.d. is correct.

4) That's fine, but you'll also need to attach additional evidence. See pg. 10-12 of the instructions for what to attach, especially pg. 11, Part 8, Section B.

5) I would prefer to put the same employment 3 times with the different dates, instead of characterising as a 3-year job.

6) Can't say, this is a very personal decision based on the specifics of each case.

Hope this helps. Good luck!

Re: Form I-129F Help

1. Yes, your SSN is yours for life, so list it on all forms asking for it.
2. Not sure, sorry.
3. Sounds like the right one, as I assume they mean multiple I-129Fs within a certain amount of time (which is not allowed) but not 100% sure, sorry.
4. It doesnt even have to be that long. The date of the first meeting, the date of the most recent meeting, and just saying we met multiple times in between in enough.
5. Personally I would put the actual dates, at least the month and year, of each individual work experience.
6. Hiring a lawyer is totally a personal preference. Many of us on here did not use a lawyer, but you certainly can if it makes you more comfy. Don't forget, though, lawyers make mistakes too, and YOU are responsible for all the forms being correct, not the lawyer. For the criminal questions, maybe just a 1- time consultation would be helpful.
