Default Flying domestically out of status

I am an Australian citizen who has overstayed his visa waiver by about
1½ years, currently living on the East Coast. I recently married an
American citizen (she was the main reason for overstaying) and we
would like to apply for AOS on the West Coast (California). I am
however wary of flying to California, as even though it's a domestic
flight, with all the beefed up security at the airports I'm bound to
be found out as out of status, detained and even deported. Are my
fears justified? Does the marriage certificate count for anything? I
dread the thought of driving all that way.

My wife was out of status (with a deportation order) for years and we
flew everywhere from LA to Portland to Seattle to Chicago to Miami,
Orlando, etc.... w/out any trouble. But that was before late 2001
when we left America for good and have not flown in America since.
Still, as late as Fall 2000 I can vouch no worries mate.

We are sick of America and planning to one day migrate to Brisbane,

You should have no problem, INS are not involved in domestic flights. You will need a picture ID, which can be your East Coast Drivers License, if you have one, or you Australian Passport.

Don't worry, America is quickly decaying (see e.g., lower Manhattan,
economy, morals, int'l relations, crime, poverty, drugs, corruption)!
I've lived in OZ and posit that life is better there beyond cavil!
Shit, even the old land in Europe is better and more modern than
America. America is the worst of the Western nations, far and away -
only Americans are too fat, dumb and arrogant to realise (no sic) it!

No dramas, 'cause 19 people brought out the Wizard of Oz from behind
the illusory curtain of power; the floodgates out of America will flow
freely if they do it again!

Far from being a wonderful thing, the notion of America as "a Nation of
immigrants" has damaged us greatly since our immigration reforms of 1965.
Just reading posts like yours warm the cockles of my heart. Just to think
that the non-assimilating types might actually be going to places far away
is wonderful indeed! We are not a Nation of Immigrants and never have been.
We're a nation of people, and founded by people, who descended from
immigrants and set up a damned nice culture until liberal offspring of more
recent arrivals in media and academics insinuated stupid notions like
diversity, multiculturalism and "tolerance 'til it hurts" into too many of
our people.

Shutting the borders while letting the likes of you, and other "huddled
masses," leave can only set us back on the right path. Now, if we could
only get that wretched statue hauled out of New York Harbor and given back
to France...after we remove the torch and extend her middle finger properly.

I notice you could not actually argue with my points! America is a
fascist Empire whose end seems near! As to your historical greatness,
lest we forget the hypocritical double-think of freedom for all
combined with slavery and lack of women's sufferage, the USE of WMD on
Japan (and Iraq is a danger - who has actually USED WMD), terrorism
through by-proxy wars in the 2nd half of the 20th century (payback's
a bitch), and the like. No, my friend, America has always been evil
and is now getting some 1% of the comeuppance due it...the worst is
yet to come I pray!

And I hope and pray that if we do receive some more "comeuppance" you feel
is "due," that you haven't been able to flee yet and that the next "ground

First, do you have any valid ID, such as an unexpired passport? If so,
just call the airline anonymously, explain that you're out-of-status
and ask whether whatever ID you have will be good enough for domestic
flights. No one is going to leap through the phone and arrest you.

Second, if you're really on the East Coast, why not apply for
adjustment of status on the East Coast?

My Dutch spouse and I applied in New Jersey about two years ago and
had absolutely no problems, even though the INS completed processing
the green card application after Sept. 11. We got a work permit in
about three months and a temporary green card in about nine months.

We used Stephen S. Mukamal, a well-known immigration lawyer who has
offices in Manhattan. I think his fee for a simple marriage-based
adjustment of status was about $2,000. The fee was definitely worth
it, because the paperwork is very easy for an immigration lawyer but
very difficult for people who aren't immigration lawyers. My suspicion
is that most people with simple cases who apply for AOS with help from
competent lawyers get through the process fairly quickly, and that the
people who suffer from terrible delays are the people who use bad
lawyers or, G-d forbid, try to handle the paperwork themselves.

Finally, for the xenophobes out there: I hate jaywalking and freaked
out every second that my spouse was out-of-status, but, the truth is
that there are probably about as many U.S. people trying to get into
places like Australia and the Netherlands as there are Australian and
Dutch people trying to get in here. Those countries send us their
would-be entrepreneurs striving to build businesses, whereas we send
them our bums hoping to wrestle alligators and lie on the streets of
Amsterdam smoking doobie.

If you really want to be hostile toward immigrants from countries that
send us Al Qaeda terrorists or flood us with poor, unskilled workers,
OK, I can sort of see your point, but why be so hostile toward
harmless lovebirds from rich countries that take about as many of our
lovebirds as they send us?

This is really a sign that you are another immigrant who just doesn't 'get
it' regarding U.S. immigration laws and the values of those people who want
our immigration laws Enforced! The fact that some morons from the U.S. want
to get into Australia or the Netherlands means ABSOLUTELY NOTHING! Am I as
an American supposed to surrender my rights to lobby for the enforcement of
our laws because of the actions of some American idiots? I mean what is
wrong with you people from overseas who don't understand the idea that
another person's actions do not obviate my rights to lobby for my laws! Get
a frigging clue!

Why are you stirring up trouble where there is none? I don't even initiate
posts in this newsgroup anymore because most people here are interested just
in Legal immigration - I just chime in to refute untrue statements and
idiotic statements like yours.

No problem, no passport control. SURELY you are in the process of applying for green card? if not hurry up! It took me 2 years to get mine, I was overstayed 5 years and travelled domestically all over. have fun the us is brill!
