Hi all,

I am hoping someone can help me.

My father is American and my mother British, therefore I am eligible for dual citizenship. I am in the middle of applying for my American passport, as I have a Social Security number etc, but I just need my passport to finalise things.

i married my husband in September 2015, and we have plans to move to be with my family (my father and my relatives out there!) in the States relatively soon. My question is, is he eligible for a green card and how would we go about moving to the States i.e paperwork, visas etc?

Hi, welcome to BE.

He can't automatically get a 'green card' just from marriage to you, but you can sponsor him for one. I'll move your thread to the marriage based visas forum, where the good folks there will be able to help you with the process of applying for an immigrant visa ('green card') for him.

He cannot get a green card in the UK. If your US citizen father had the ability to pass on his US Citizenship to his child if you were born outside of the US, then you have always been a dual citizen. The US Passport is only paper proof of it. You can petition for your husband to get a spousal visa (IR-1) (Immediate Relative Visa) through the US Embassy in London. After the visa is issued, he needs to enter the US with you, his passport will be stamped with an I-551 and the actual green card will be mailed to him at the US address he specifies on the paperwork. A green card is only a symbol of his status ... .Permanent Resident. It will take from 6 to 8 months to obtain the IR-1 visa. There is also the issue of financial sponsorship of your husband for the IR-1 visa.

When you say you want to move with your family ... who are your family members? Children? Your father? Your British mother? If you have children together, there is more that we need to know and you need to find out about their ability to come to and reside in the US.
