Good. I would actually suggest hiring an attorney for your case. Even with all the reading and research you said you've done, you're still way off base with simple things like getting the medical done, and where to send the forms. You REALLY need to be very detail-oriented and VERY organized to do this on your own. You might want to go ahead and hire the lawyer to help you wade through all this stuff that's still confusing you.

Errrr..I'm not as familiar with the route the OP is taking, but I thought that she could only file the I-485 once they had received the NOA for the I-130? Is that still the case? if that's the case, won't she have to wait til after the fee hike to file the I-485? Or am I way off base? Not that I'm trying to confuse her even more!

Judging by this part of the original post:

"Basically, my bf is here on a B-2 from New Zealand - he visited me in
January for a couple weeks (2) on a visa waiver and got his B-2 a couple
months of being back home after that, and has been here since March. We
have decided to get married and file for permanent residency for him."

It sounds like they are wanting to AOS here, which means filing the I-130, I-485, and all other forms and supporting documents together to the Chicago lockbox.

well, we've got the medical done and those results will be ready by
friday and we're now married. we'll have the consult by monday with
the attorney.

the reason we've done so much research and we're still unsure of a bit
is because we've learned anything we could from scratch with virtually
no knowledge of any part of the process - it's an awful lot of knowledge
to take in in a short period of time, and we've only tried to learn it
since we decided to get married a month or so ago =)

and yes Rene, you're correct - it is an AOS.

Based on some of the other posts here, I have a question regarding the
medical - he did get his medical done, and the doctor said that he
needed record of his MMR and tetanus shots - we also went to get his TB
test done - my question is - is the MMR and tetanus record required
*with* the AOS packet or not? Can we submit the full medical without
those shots?

I notice on the form that it has a box to check for the doctor that has
'advised' the patient to get the immunizations, but nowhere do I see
that it's required. He has had them but it could take a while to get
proof of those records, and we just wanted to know if he absolutely had
to have them before we file.

yikes- meauxna and rene, I wasn't ignoring your posts, they simply
slipped in at the same time I was posting and I missed them =)

we're certainly not perfect and I definitely had missed a couple things
that when re-reading I was able to catch, and for the most part now I
think we're pretty crystal clear - in any case, we're still meeting with
the attorney on monday. Meauxna - we weren't set on filing the I-130
alone, I was just a bit confused about that as I'd read different things
- as you've said, every case is different and I wasn't positive which
would apply to mine considering the instructions on the application say
one thing and I was told another =)

about the medical exam, I definitely have seen over and over again that
the immunizations aren't required.. so I'm assuming they aren't - the
doctor just made them seem like they were, which is why we were trying
to get his records. I imagine by everything I've read that he only needs
to get them if they request he does. He has already had them, but
scrambling for records when they arent required seems like a bit too
much to be concerned with when we have other things to worry about.

Thank you both heaps for your knowledge - I know it's easy to look at
someone's post and think oh god, another one who doesn't know how to
google - I do and have, but obviously, with things like this and so much
knowledge to make your brain explode, it's always good to get more
information, and I'm glad I did because I obviously missed a few things
- and as is said a thousand times, every case is different =) the
attorney said based on what we have she should be able to put it all
together by wednesday. she's given me quite a bit of info without
consultation as we have our consultation scheduled, so Ill have my
fingers crossed til the full packet is in the mail
