Filing I-129F petition while in the U.S.

Filing I-129F petition while in the U.S.
Can one be in the US, with a tourist visa for example, while his or her fiance(e) files a I-129F petition for him/her? Can one then leave the US and go back to his/her home country and wait for the first NOA?

Why would that be a problem? Since you can visit after a petition has
been issued (the only thing you need to prove is that you're tied to
your homeland...on arrival). I never heard anything about not being
able to get ENGAGED on a VWP :-)

I'm curious as to why you're asking the question, since you've already gone thru the K-1 process and had your AOS interview. I see they're requesting additional information -- is that why you're wondering about this?

Additionally, there would be no problem getting married on VWP or a
tourist visa and then returning to the home country to get the CR-1 visa.

I was in the US while my husband and I sent off the I-129F petition and had no problems.

Thank you all for your help! As Jay-S perfectly knows, yes, sometimes I ask questions on behalf of other people whom I also redirect to this NG ; ) I already went through the process, but i found myself unable to answer other people's questions many times, since it never occured to me to do this or that the same way. In these situations, I usually ask here, Jenney : )
