filing fiance visa: done by fiancee or not?
Here's a question about the fiance visa. We want to file this
(he-Dutch, she-American) from Wisconsin. On a site we found out that
this will have to go to the Nebraska processing center
(unfortunately). Well- our case is that we will be in the Netherlands
for the next year so the questions are:
Where do you have to file your first form for the fiance visa? Can it
be done by mail or in what city do you have to file (living in
Wisconsin)?
Would it be possible for us to fill in the form and send it to the
Nebraska processing center or for the fiancee's American mother to
file it for her daughter? This way we could keep on living in the
Netherlands and still get the process started (as it seems to take 7
months for the center to process any fiance visa).
So in other words: does she have to be in the US while the fiance visa
process takes place or not?

If you're already in NL, you're halfway to the US. You can marry now and file a petition I-130 directly with the Consulate overseas and then apply for an immigrant visa. Upon entry, a green card will be mailed to the newest conditional permanent resident of the US (PS: that's your foreign spouse!)
The entire process is very short; something like less than a month, IIRC.

Well Paul, read those FAQ carefully and maybe there is an answer there.
You know, I don't know anything about fiance visa, but she has to claim a
residence in America.
And if you assemble all the papers and evidence and send it to her mom and
her mom mails it from Wisconsin , then what is the difference if she mails
it herself from Wisconsin? They do not fingerprint the envelope I
hope.(taking a wild stab at humor)
So, NO her mom cannot file for her.....but her mom sure can pop it in the
mailbox for her.(I think we are saying the same thing but translates
difficult)
I assume her mom is the cosponsor, so she will be claiming residence with
mom in Wiscnsin?
anyway.....see if you can find your answers in the FAQ. I think you will
have to read between the lines as your question may not be specifically
answered. OR post it at that fiance visa site. Maybe somebody else has
done what you are considering.

Thanks Eileen, your answer is - as always - clear! Yes she will be
residing with her mother in Wisconsin and yes - her mother will be
co-sponsoring. So basically what you say is that it should be possible
to do this because it is just mailing in a form?
I have seen various timelines from the Nebraska service center and
most of them are about 7 months before the first interview. I guess
before this time, there is no need for her to be residing in the US?
Does anybody have any experiences with our situation?

I am just dying. Is there a reason why you don't want to file directly through the embassy? Eileen's advice makes sense if you really need or want to use the K-1 as your means of obtaining US residency. The Direct Consular Filing option that Meauxna tried to steer you towards makes the most sense if you are not attached to the K-1 method. You wouldn't even have to deal with the service center until you had been married 21 months.

Being a survivor of the Nebraska Service Center after 179 days of a grueling wait I would definitely suggest doing the DCF in the Netherlands!!! It's so much easier!! You don't have to adjust status or anything!! One less procedure to pay for!! It's cheaper and faster to DCF at the consulate there in the netherlands!! So please look at all the links that Meauxna put on this thread and save yourself money and time!!
