I know you are feeling more than a wee bit upset and frustrated at this point having filed for AOS long before tcylinder and mrsm but it would appear from their responses to my questions that they filed in the time period when all I-485 (AOS) petitions and their accommodating side benefit applications were under the new procedure and were forwarded to MSC/NBC for processing. It seems patently unfair that having filed a year after you, they are now both assigned appointment dates for adjudication of their I-485 while you and Rita are still sitting there with no word from the NYC DO as to the final processing of your petition.

It was my assumption and hope that this new procedure would leave the DOs open to complete processing of the long overdue filed I-485s since the DOs no longer handle assigning appointments for fingerprinting, and the processing of EADs and A/Ps thus leaving them free to eliminate the backlog of overdue I-485's. As I've seen so often with the INS/BCIS and USCIS, they are still doing things ass backwards and dealing with new cases and forgetting the older ones.

I have no advice for you and can only offer you my sympathies for the longer than necessary wait and kudos on the huge amount of patience you have shown.

I'll echo that. I have finally received my interview appointment for
early June which will make it 26 months since filing in NYC. It has
been a very frustrating, worrying and expensive process. It's quite
natural to feel upset when you've endured such a long wait, only to
see a new process installed which expedites filers who applied way
after you did. All I can say is keep the faith, have patience and
console yourself with the fact that a 2+ year timeline at least gives
you an unconditional GC and means you won't have to deal with the
USCIS for another decade.

Believe it or not I too offer sympathies to you. Somebody (Rete no doubt) did mention before that this would happen once cases started being forwarded to NBC/MSC. The newer cases would be dealt with first due to USCIS not knowing how to do anything logically or resembling order. As I said, we never expected to hear about an interview for at least another year and no, it doesn't make sense with so many people waiting for their interviews. While I am happy we have our interview, I sincerely do think that it is very unfair that you have had to wait this long while we are "jumping the queue". Wishing you all the very best and a speedy resolution.

again; CIS currect page 4-15-04 says that it's now processing aos
applications received 6-11-01

I am not familiar with your situation but from reading Rete's post I can see that your case is being handled in an unprofessional manner - which is not out of the norm for USCIS as we all know too well. I was shocked and confused when we got our interview date as I wasn't expecting anything for quite some time. Of course I am happy that things are moving along but knowing that others are getting screwed makes me angry. I think being angry is good as it is one of the best motivators. I think you should start writing and faxing people in office for their assistance. I would encourage you to write, fax and even visit the offices of Senator Chuck Schumer here in NY. After my wife and I submitted AOS we never received a yellow register receipt and were feeling uneasy about not getting this. I looked up Charles Schumer on the web and found his website where they list their mailing and physical address. I wrote to the office and shortly after, we received our first NOA for the I-485. After that, I recieved a form letter from Schumer's office stating that they were investigating the situation. So I'm not sure if they actually did anything or not but they do have to read and respond to all letters.
Again, I am not familiar with your case and maybe you have already written our local NY politicians. If not, it might help you to light a fire under someone's ass and also make you feel better than doing nothing but waiting for these people to do their job and process applications in a timely manner.

Rete: Thanks so much for your understanding, it does get frustrating at times.

The changing rules & regs, lol

Anyway, does the fact that NYC i-485 applications go the MSC/NBC route, that
now all Green Card interviews will take place around 14 months or so after they
are received.

Good for new applicants, we'll just wait em out though, lol.

I found the envelope that the AOS appointment NOA came in. It was from Lee's Summit Missouri.
