fiance visa vs. spousal visa
Which is faster a spousal visa or a fiance visa?
a PR from the Philipines wants to marry his girlfriend from the Philippines and bring
her here. He already has children by her (eldest
13) but they are not married. What is his best option?
I think he should file for citizenship after having been here for 4
14/2 years and I guess on the day he is granted citizenship he should do the paper
work for the fiance visa.
He is getting a little anxious about not being married to her and may want to just
get married there in the next year. Does that delay her eventual arrival to the U.S.
significantly or make it harder in any way?

Can someone please try and respond to this? I've asked some difficult questions and I
sort of think this one isn't so hard but maybe I'm wrong! And then I read about a "V
- visa", I'd like to know if that makes for some other options. - Thanks

The K1 should be the faster route (6-9 months). The k-3 takes about (9-14 months).
The reasoning that the K1 is faster is because the INS is actually only granting a tourist visa for your spouse until you file the adjustment to change her status.
However, the INS in granting the k3 is actually giving your spouse a green card. After all, you are two are married, and you are technically applying for her visa as your spouse. This is more valuable in the eyes of the INS.
Nonetheless, there have been talks on capitol hill to shorten the k-3 processing time to 6 months to make it more in line with the k-1.
To be safe, I would go for the k-1. However, the k-1 has a more stringent financial support requirement.

I got my spouse visa (my wife is a USC) last year in just five months through the London embassy. I have heard that it can take as little as four months if you are lucky.

It is a known fact that US never rejects a British K1/K3 unless there is like a felony conviction.. England is a like a second brother to the US.
I am talking about countries like Nigeria, Vietnam, Pakistan, India, and other countries lower on the totem pole.

If you filed via "DCF" then timelines are generally much shorter. If the
USC is in the US, however, K-1 is faster than a spouse visa filed in the
US.
