Default fiance visa French

Hello,

Does anyone know how much time it can take to be approved for a fiance
visa (K1 I believe) when the fiancee is French?

Also can the fiancee apply at the Green Card lottery at the same time
without being penalized?

It all depends on what office you go through....some take longer than others. Considering the fiancee is French though it probably shouldn't cause any extra delays as perhaps other countries might.

Why would you want to do the lottery. If you are getting married you should get the greencard. Assuming the marriage is legitimate.

I entered the Diversity Lottery before Steve proposed. I entered it years ago and was successful but didn't take it up as I was in a relationship with someone in the UK. Now that's what I call irony!

your fiance being french is not an issue. what matters is what service center
are you going through? nebraska, vermont, etc.......

my husband is from france. what took so long wasthe f...king NCS - 237 day!!!!
after that all went smoothly.

if your interested you guys can file directly at the paris consulate. first
you gotta get married. doesn't matter where. i would suggest USA becuase it's
easier than in france.

Hello, thank you for the answers. For the people wondering, yes it
would be a real marriage, after being in relationship for 3 years. I
was thinking about the diversity loterry because I thought it may be
faster than the other way, and if it doesn't penalize me, why not?

Regarding the service, it would be Rhode Island, do you know if they
are rather long or quick? U said to get married first, I heard that
someone cannot go to the US in order to get married, it is considered
fraud. Is getting married in France any better ? (faster?)....

You can't enter the US to marry your USC under the VWP and stay there. That would be a bad thing.

You can get married, leave and apply the K3 route or stay in France and apply via K1 fiance visa.

I was referring to if you went to the US under VWP and got married and stayed there. You can get married there and then have to leave once your legal length of stay is up. Then go you back to from whence you came and apply for the K3.

You "may" also have problems at POE if you enter under VWP to marry your USC fiance.

I'm doing via K1 as for my circumstances that seems to be the cleanest and quickest way.

CRYSTAL ( USA) and PATRICK ( France ) K1 TIME PROCESSING



FEBRUARY 4th I-129F sent to INS NEBRASKA by Certified mail with
DAY 0 return receipt


FEBRUARY 26th Notice Of Action received from INS NEBRASKA
DAY 22 with a file number and a phone number to check about our case


APRIL 7th Notice Of Approval received from INS NEBRASKA
DAY 62 Our file was send to US Embassy in PARIS


APRIL 23th Checking list received from US Embassy in PARIS
DAY 78


APRIL 23th Checking list sent back to US Embassy in PARIS
DAY 78 ( i already had gathered all the needed documents, you will save time
by asking the Embassy to send you the list of requested documents ) Do it
during the first phase of filling.


APRIL 29th US Embassy called to give me the date of interview
DAY 84 It will be on MAY 14th


MAY 13th 10h00am Medical Exam
DAY 98 XRAY, Blood test, Doctor interview.
04h00pm Doctor give me an envelop with the results to give to
Consulate.



MAY 14th 10h00 Interview at US Embassy PARIS
DAY 99 A woman asked me for some documents . ( Criminal record, Birth
Certificate)
11h00 Then i had to meet a consulate Officer, he asked me 5 questions
    :
When did you meet her?
When did you visit her?
What job is she doing?
Do you ever meet the parents?
Where do they live?
Are you going to have a religious marriage?
And he gave me a piece of paper and told me to come back between 3pm and 4pm to
get my visa.

15h00 Back to the Consulate
I showed the piece of paper and the Officer gave me my passport with the K1
VISA!!!!!
I was so happy!!! I called CRYSTAL immediatly from the phone both inside the
Consulate!!! So great!!
After calling her, i wanted to look at MY visa again!!
And in SEX, they typed F!!!!!!!! L-
I had to ask about that and i had to wait one more hour while they issue me a
new visa with MALE!!!!!
Hopefully i checked it immediatly! I dont want to think what would have happen
if Immigration at the POE discovered a mistake like this one on your visa!!!

Well, everything turned finally good after 100 DAYS.

I would suggest:
Fill out the application in the USA then France to get the K1 visa for your
french fiance, then get married under the K1 visa ( 3 months after entering the
US territory).

If you're in Rhode Island, you're serviced by Vermont Service Center which is the quickest of the whole bunch.

It is hard to say. Folinskyinla always says that he never gives a timeline to his clients as it is just too hard to guess. Probably anywhere between 3 months and 12 months... If you want to attend your brother's wedding in the summer, you should be able to do so if your fiance files the I-129F now, as you have 6 months after you have the visa in hand to enter the US. I wouldn't try to squeeze AOS and get AP to go visit for your brother's wedding, but this is just a personal opinion.

Also, I would make sure before starting the K-1 process that you do want to get married in the US with little time to organize a wedding given the non-predictable timelines for immigration [For us, we did courthouse in the US and religious in France 6 months afterwards, but that was because I was already in the US and the Paris consulate did not do DCF at that time]. Apparently, the Paris consulate has been reported to do DCF (to check). This would be the least painful method to use. You could have your wedding in France with your family and immigrate virtually hassle-free and quick to the US (having PR status upon entry as opposed to have to file AOS after getting married on your K-1). Of course, you need to check with the US embassy that they do indeed DCF.
