If I may be so bold we are also talking about a country (Thailand) where the parents of a 16 year old may want a better life for thier daughter in the states than what may be available in Thailand (from what I've heard).
and for the record my fiance is my age (which is nobodys biz except to say well over the age of consent) thank you very much.

Ranjini (and others),
The age of consent (as the expression is most commonly used)and the age at which one can marry without parental consent are not the same thing...

ray,
Thailand? Laos and Cambodia, yes, but Thailand? Mmmmm... no.
Many Thai women become sex-workers of their own volition, and young women from even poorer surrounding countries may be sold into the trade in the home country or in Thailand by their parents. It is also true that Thai women are lured into the sex-trade in other, richer countries by unscrupulous recruiters with offers of work that turn out to be something else entirely from what was promised.
But the Thai parent who would sell their child is very rare indeed

T-M,
According to the web site of US embassy in Bangkok, people under the age of 20 need parental permission to marry in Thailand.
According to web site of the Thai Department of Provincial Affairs, Ministry of Interior, people under the age of 17 require both parental consent and the approval of the court to marry.
Again, I don't know how much consideration the IV unit in Bangkok is going to give to this since the marriage is proposed to take place in the USA, not in Thailand, but I expect that they will look at this situation with a very jaundiced eye.

T-M,
I believe that a 16 year old Thai needs her parent's consent to marry. I don't know if the USCIS will take that into consideration when reviewing your petition (possible RFE material?) or if consular section in Bangkok will take that into consideration when reviewing her visa application.
I also don't know what California state or local law might be with regard to a 16 year old marrying. She'll probably be at least 17 by the time she's able to get there.

That's how Gary Burnore met Belinda! He paid her trailer-trash
parents to take her away with him. They didn't know he was just
another heartland-hillbilly with a hard-on and no brains. He really
_is_ a sex offender, you know. Not the pedophile kind - he porked
some 15 year old lived in the double-wide next door, or something.
You can look it up.

One can look up the user name of "december" from 1998 or 1999 for a case where a female from Canada was going for the K-1 so she could marry her Texas based fiancee. Her single mother gave written permission, she got the K-1, went to Texas, married and had kids and last I heard was filing for removal of conditions. So not every young person comes from a under privileged or third world nation. BTW her real name was December. Mom was a good Catholic from Quebec and ran out of names for her many children.
