A few questions about I-134

Hello all, today I am working on completing the I-134 Affidavit of
Support that my fiancé Andrew will take with him to his interview at
the London Consulate. As some background, I (the USC) am a recent
college graduate, and for the last 6 months (immediately following my
commencement ceremony!) I have been working at a sufficiently
well-paying job in my career field of cognitive neuroscience research.
I did work through college, but never full-time. My financial
history and current resources are very stable but by no means
impressive.
My questions are regarding Item 7 on the I-134 form:
1. "I have on deposit in savings banks in the United States..." - This
is a little confusing to me because I have a checking account as well
as a savings account at my credit union. I only have a few hundred
dollars in my savings account, which I haven't touched in years. Most
of the worth I have to my name, including my job earnings, is kept in
my checking account, but of course this balance is always changing as
I pay bills, etc. What should I report to the INS here? Should I
consider moving as much of the balance of my checking account as I can
afford into my savings account?
2. "I have other personal property, the reasonable value of which
is..." - Well, the true answer to this question is 'negligable'. I
don't own real estate, I don't own a car, all I really have that is
worth much is my computer, stereo, that sort of thing. Is their value
worth reporting, or is this question only meant for people who have
proper valuables?
3. Just to have this affirmed, am I right in understanding that I do
NOT need to send income tax records with this form for Andrew's London
interview -- that they are only required at the time of our AOS
interview? All that I see listed under "Supporting Evidence" for this
form (because I am not self-employed) are a statement from my
financial institution and a statement from my employer.
Thank you so much,
Kristin

Kristin,
I'll try to answer what I can from my own understanding as I am going
through this process now myself with London Consulate. Basically, it's the
DS-2000 requirement that is being implemented by I-134 and you need to
provide proof that your fiancé will not be a public charge; The URL is for
London is
http://www.usembassy.org.uk/cons_web...faffidavit.htm.
So pay attention to the Affidavit of Support section. The most important
detail are at the top: Information regarding his/her annual income. If you
meet 125% of the poverty level, then you are fine. As for the rest, give
best estimate, as you'll need it for I-864 at the next stage anyway, doesn't
hurt to start compiling the data now.
I believe you do need the income tax records for the interview and it takes
up to 8 weeks to get the full copy (quicker and easier to get tax return
transcripts (go to www.irs.gov). And it doesn't hurt bring them and not use
it if they don't ask for it right? (Way better than to be asked for them
and not able to produce them) You also need to get the I-134 notarized (or
have an immigration officer certify it if you are up for that) at your bank
or any Notary Public.
Where are you with the packet three process?

2. I listed my car, and other assets like furniture, computer and that sort of stuff.
3. I did not send any income tax forms just a letter from my employer stating that I am a permanent employee, when I started, how much I make, and my s.s. #.
Good luck-T.

Hi everyone,
Well I am not actually on this part of the process, because my K3 has stil not been approved. But lately I've been paying more attention to the I-134 since that is the Affidavit that we are going to be using. the form itself does not mention anything about having to provide the last 3 years of the tax returns. Please CORRECT me if I am indeed wrong! So why is everyone gathering their tax returns for the I-134, isn't the employer letter just fine??? I know that we will need the 3 years of tax return for the I-864 when we file for AOS.
I am truly CONFUSED. Please help clarify, because a just noticed that loveabrit did not sent her tax returns, and I would hate for ANYONE to be denied on this basis.
Thanks,
Claudia

Claudia,
I think the answer is that, even though the I-134 doesn't require tax
returns, some Embassies do require them. If I'm incorrect about this,
someone will surely correct me.

So you guys would suggest to contact the Consulate directly and find out what forms they would require for the I-134!

Hi Saha,
I'm sorry; I didn't quite understand your question, but I'll try to answer. Well I petitioned my husband on the I-130 and then opted for the K3. I am expecting an approval for the K3 way before the I-130, so that's why I'm worried about the I-134. I'll start to worry about the I-864 later for the AOS!!! I don't even want to give that thought YET!!!

reading through my DS-2000 instructions on the back it has a section for the I-134 (by the way london embassy) it says
to substantiate the information regarding income and resources the sponsor should attach two or more of the following items to this affradavit
1. notarized copies of his or her latest income tax return
2 a statement from employer, including salary and length of employment
3 statement from an officer of a bank regarding the account
4. any other evidence adequate to establish financial ability.
this is what i received from london thanksgiving day, i think you can download this info off the london website, it is a seperate form than the I-134 but it gives a clearer picture of what is required
hope it helps

Thanks claudia13839:
When do they ask for I-134 or I-864? During submission of packet #3 or later?

Saha,
The Affidavit of Support is to be taken to the Consulate the day of the interview. You do not send that in with the check list. Hope this helps.
