felony issues prohibit foriegn fiancee?

Default felony issues prohibit foriegn fiancee?

My fiancee lives in Chile. We are in the process of filing the I-129F. In
the I-129F application, Part C, question 2 asks... have you been convicted
of (list of various crimes)... my question is, if you are 2 consenting
adults... does the fact that you have a felony on your record somehow
inhibit your ability to legally marry an alien and bring her to the USA?

Can in inhibit your ability? Yes. Will it inhibit your ability? Maybe... maybe not. Which one of you committed the felony? How long ago was it? It probably will *not* affect your ability to marry her... it probably *will* affect your ability to bring her to the US.

The US Citizen... was 10 years ago.

So why would a felony commited by the american inhibit their ability to
marry and have an alien come to USA? I have paid my price to society...

Between two consenting adult implies statutory R*** but: 10 years ago
you weren't likely to get on a registered list. If you read the
petitions carefully it says of the USC (read it yourself to be certain
what I say is true, this is primarily directed at violence against
women... )... convicted of two or more spousal batteries blah blah
blah. If so, I think you need to petition a judge.

What immigration is having trouble with is guys who import women to
beat them on the one hand and the Russian women who seem to get beaten
within hours after arrival, rush off to the court house for the
restraining order and they are suddenly "battered immigrants" Both
stereo types are what immigration is trying to weed out.

I believe "felony conviction" isn't the issue, it's drug related and
wife beating offenses that are being screened. Go check out the
various forms instructions and perhaps discover that episode 10 years
ago won't stop your petition. READ IT and don't rely on me... I just
noticed that in the instructions somewhere... I'm no expert. david

It depends what the felony conviction was for... your comment about "2 consenting adults" brings to mind the Adam Walsh Act.

"Under the Adam Walsh Act, U.S Citizens and lawful permanent residents (green card holders) who have been convicted of any "specified offense against a minor" are prohibited from filing any family-based immigrant petition on behalf of any beneficiary, unless the Secretary of Homeland Security (DHS) determines (in DHS's sole and un-reviewable discretion) that the petitioner poses no risk to the beneficiary. Thank David... where can I find the USC you mention online??

In the "glossary of terms" the USC is YOU.
United States Citizen :-)
Somewhere there's a glossary but I can't remember where.
