Sorry but it doesn't clear it up for me.

This is what you originally posted from the US Consulate website:

Important: If the immigrant visa petition has been filed or will be filed with the INS in the United States or you are applying for a family or employment based immigrant visa, do not download and send these forms (REFERRING TO PACKET 3) to the NVC until they have notified you that they are ready to proceed with your application. Forms received before NVC officially notify you that they are ready to process your case will be discarded.


It clearly states do not send packet 3 forms to NVC before NVC has notified you that they are ready to proceed with your application. This does not mention the US Consulate but NVC which is in New Hampshire, USA.

Have people actually been opening provisional files with NVC before the service center approves the I-130 and forwards it to NVC?

What exactly is in packet 3 which is send to you from the NVC? Is it the same packet that formally was sent to the UKC by the Consulate? The same packet that the rest of the foreign spouses receive worldwide from NVC? Does the NVC it include the agent's assignment letter? What about the affidavit of support does NVC have to be involved with that as it is with the rest I-130's processed worldwide? Do you have to send them your visa fee or is it still being handled by a bank in England?

My intent is not to confuse people but to clarify this procedure in my mind so that I won't unintentionally confuse people now or in the future. So please view this post as an exploratory one only folks.

You brought up some very interesting points. As far as London is concerned the NVC is not involved in the visa process - packet 3 and 4 are sent from London, the money is paid to London, Affadavit of supports are handled by London. As far as the NVC is concerned they have no involvement apart from processing the petition.

The London Embassy is sending packets 3 back (see Dees postings), that paragraph (that I cut and paste) used to say that you can download and file packet 3 before your NOA it now mentions NVC- this is the confusion I feel as the whole page talks about filing in London - I think I owe you an appology as I read the whole page and put 2 and 2 together and got 5
