Default entered on visa waiver now applying for AOS, any advice?

I entered the country under the Visa Waiver program and me and my wife
just got married. After 3 years of long distance dating.
It was a spur of the moment thing, we just decided to do it! She is a
US citizen and Im British we want to live together in the USA.
I have most of the papers in order just checking Im not missing
anything?

I-485
I-765
I-131
G325

Do I need to file an Affidavit of Support (I-864)?

Thanks

You are forgetting the most important petition of them all for someone in your position: I-130 Immediate Relative Visa Petition.
Without that, you can't adjust status.

Also it is two G-325A's, one for you and one for her. Also you do need to submit her I-864 with three years of tax returns, registered marriage certificate, slew of ADIT photos of you and a set of her, a medical which is required at time of filing by many INS offices, her proof of citizenship and your long form birth certificate, copy of the I-94 in your passport, etc.

You can check it out at:

Accept the disclaimer and note that the fees are incorrect but the information valid.

Spur of the moment huh? :))))

Anyway, I am sure someone can give you the list of forms.
Otherwise: why not just call the Service Center, within one
week you will have a brown envelope with everything you
need, just to be sure.
