Default Employment and K-1 visa

My fiance arrived last week. It is my understanding that he can work (after he gets
his social security card) based on the K-1 visa and his I-94 and we do not have to
wait for employment authorization. Is this correct. I do not want to screw anything
up. Thanks.

You MUST have a EAD to work. Read these pages for more info [url="http://www.ins.usd-

You can try, but you are almost guaranteed to experience a gap in employment
authorization between when the K1 visa expires and when you get a new EAD based on a
pending adjustment application. Most employers won't accept a foreign passport with
an I94 indicating K1 status as proof of employment eligibility.

The K1 work permission is mostly provided to give you social security card
eligibility (which you may need to get a marriage license) and perhaps driver's
license application eligibility. Basically, to help get set-up in the USA in
preparation for the marriage.
