EAD, temp EAD, and NOA...

Default EAD, temp EAD, and NOA...

We mailed off the forms for AOS and EAD on the 15th of Feb, US Postal
service says it arrived on the 17th, but we still haven't received a
NOA.

I have a question about the temp EAD: will they start counting the 90's
wait on that from the time that the US Postal service gives, or the
time that the NOA says (whenever they get around to sending one out)?

We mailed in our Adjustment of Status application Feb 16, 2005 to the Lockbox addy & didn't get our NOA1 till yesterday.

The NOA1 was dated for Feb 17, so that's good at least.

And I'm fairly certain the count starts on the date on the NOA.

Granted this was in 2003, but when I sent my forms in (to Atlanta) it took about 3 weeks for the letter to arrive.

You start counting from the NOA date, which is the "notice" date (NOT the "receipt" date).

I think my NOA was off one day (earlier?) than the check cleared, HOWEVER they write the tracking number on the back of the check. So if your bank shows an image of the cashed check on your online statement then you can figure out the number and check up on your status even before your letter arrives. Just look out for that number that starts with "MSC...." (or whatever).

Hey there!
Give it a little more time, sometimes It takes longer.
As for the countdown to get an interim EAD.. you need the NOA1 before you can start counting the 90 days, sorry!!

I was being "safe" and used a US Postal Money Order -- and to even find
out if it's been cashed will take weeks.

Yeah, that's what I was afraid of. I hope it's dated the 17th (and
although I wouldn't wish anyone else the wait, your wait gives me
hope).

Yeah, as everything in this process, waiting is horrible. I know I was starting to worry about not getting the NOA too...

No, I don't think so. The "receipt" date is the date the application is
accepted by USCIS. (Not necessarily the postal receipt date, which is
the date it arrives in the P.O. Drawer that is then picked up by the
mailroom contractor.)

The "notice" date is the date the notice is printed. CLAIMS
automatically inserts this date; there is no manual control AFAIK.

So start counting from the "receipt" date that is printed on the Notice
of Action.
