Rete was nice enough to provide me with a link that explained basically what you outlined there, that showing that you have applied should be adequate proof enough to continue working. It's in a thread I posted in this forum a few days ago.

However, I found another immigration lawyer site that said showing proof of application is not sufficient to demonstrate your eligibility to work. The way I looked at it is if your card expires July 30th, and you've applied for a new one, there is the chance the new card wouldn't start until after July 30th. There are no guarentees that the USCIS will process your application in time, and that lapse would mean you worked illegally for a time, even if you and your employer were not aware of it.

I read somewhere that unauthorized employment is forgiven for people undergoing AOS, and that the brunt lands on the employer.

Very slim chance of that happening also. It's pretty rare that they get audited and i would think that especially if they have something in the file for proof that you applied for EAD renewal then they wouldnt get into trouble. It's not like they are running an illegal sweat shop or something. I am just hoping for you that you dont have to miss work or loose your job over it.

My EAD (based on a K3 visa ) expires in March 2005. I was expecting to have an interview (via Boston) well before that, but it looks like that may not be so. I was planning on waiting for an interview date (in the hopes that it would be before March 23, 2005) so that I could save myself $175. I'm too nervous to wait any longer though.
My question (to Susie or anyone else) is whether you checked off renewal for EAD or not on the form. My concern is that as a K3 awaiting adjustment, you're applying based on the AOS, not on the K3 (as that won't be valid soon). So it's not really a renewal as it's not based on the same status.

question on EAD. I'm a k-3 holder. If biometrics for my EAD [first time] took place latter part of August 2004 and by end of November I haven't received anything from UCIS, can I go to my local INS office and request interim EAD?
