EAD Renewal
 
Has anyone else had problems renewing their EAD?

I applied for mine in November, went for my biometrics in December. Took along my passport, visa.... Was told a renewal was a formality and the card would be sent out.

Just received a letter requesting a copy of my I-94, passport, visa, marriage certificate. Along with hubby's L1 and I-129 approval notice.

My permit runs out on Feb 14. The letter states I have to provide proof by Feb 20.

Are they treating this as a new permit by mistake, or do you think I have got a problem?

Filing for an EAD is always the same procedure, whether or not you have had one before. You still need to prove all the elements of eligibility - your L-2 status, your maintenance of status, current passport, etc. If you did not provide this first time, that is why you are being asked now.

If you are working on the EAD, you need to respond ASAP. If the current EAD expires before the new one is approved, you will have to come off payroll.

They did have everything the 1st time around, and I gave it all to the officer when I had my biometrics appointment in Decmber. None of the information has even changed since the original was issued, same visas, same passport, same I-94.

If they need it again, why don't they ask for it when you fill out the renewal application which I did back in November.

There will be 19 days of my current EAD left when they receive the info tomorrow. I put a cover letter in stating that my card expires on Feb 14 and asking for them to expedite the application.

Do's anyone know the chances of the re-issue happening in that time frame?

I was saying they have had it twice, once with the application AND at the biometrics appointment.

Any ideas of the chances of getting it back in the time frame Meauxna?

Well that's just crazy.

The local offices no longer have the power to make/issue EADs, BUT, the officers there DO have a way to contact the EAD production people and light a fire.

I have no idea how fast they would turn it around on its own, but I think if I were me, I'd make an InfoPass appointment for about a week after I knew they'd received the materials, would take all my evidence in again, and proof of when the material was first sent in, and bat my eyes and plead my case there. And if they don't offer, ask if there isn't *someone* they could contact to expedite the EAD...

It's about all you can do. :(

Yikes, this isn't sounding good. Thanks for the info even though its not what I wanted to hear.

I don't have any proof of originally sending the info. I filed electronically, and posted the supporting paperwork.

It never occured to me that they hadn't received it, stupidly I presumed that if they hadn't received it they might have told me at the biometrics appointment or not taken 60 days to contact me.

I've sent all the documents guaranteed delivery for tomorrow with proof of delivery.

Even without that, I'd still go in and spin the best story I could & go for the sympathy vote. :)

I understand your frustration, however CIS needs everything again because they don't know that nothing has changed. They don't know that your husband is working for the same company, that you haven't a new I-94, etc. Yes, they could check their records but they don't do that - the applicant has to provide everything, not assume that CIS will do their own research.

Next time, please, please keep a copy of everything that you send, and mail it by Priority Mail, FedEx, or some other way you can track receipt. Also, I recommend filing for a new EAD 5-6 months before the old one expires. You might end up with an overlap, but that's better than a gap.

Unfortunately, the staff at the Application Support Centers do not review immigration applications. They probably had no idea that your file was incomplete, if it was.

As Meauxna said, your best bet is to make an Infopass appointment. CIS is supposed to adjudicate EADs within 90 days. If they haven't made a decision in that time, an applicant can visit their local CIS District Office who can make an inquiry on their behalf. If the 765 has not been pending for 90 days, but you get a sympathetic CIS officer, they might make an inquiry anyway.

Hi - I sent in my application for and EAD in early December online (I'm on an E2 spouses visa), then mailed in copies of everything including photos as i had always done that when I mailed the application in, plus I could not work out if they wanted them, coz in one place it said don't send photos but when i phoned them they said send everything you have. I then got a letter saying come in for biometrics, which is the first time I was asked to do that, assumed it was because I did the application online - won't do that again - did the biometrics and now I'm waiting, that was on the 31st December - still no EAD and no letter saying they needed more info - the joys.

Spoke to Customer Services today in follow up to my letter asking them to expedite my case.

I was told I will hear back from them within 5 days.

Just logged on to my case tracking info, and it says my card has today been sent for printing.

This is great if its true, not sure though if it is just what shows to expedite the case.

I also have an infopass appointment booked for this Friday, that I will now change to middle of next week.

:fingerscrossed: its moving and I will have my new EAD before Feb 14th.
