Default EAD - Question for Micheal D. Young

Question for Micheal D. Young (or anyone else who might know the answer). I
called the SS Office to inquire about something I read on the I-9 (the form
employers use to verify you are authorized to work) What I wanted to know if
the following statement taken from the I-9 is literal or not....The SS
Office said my understanding of the document was correct.

***Excerpt from I-9 form***

Section 2 - Employer

Employers must complete Section 2 by examining evidence of identity and
employment eligibiligty within 3 business days of the date employment
begins. If employees are authorized to work, but are unable to present the
required document(s) within three business days, they must present a receipt
for the application of the document(s) within three business days and the
actual document(s) within ninety (90) days.

What I gather from the above is if I don't have my EAD yet but I have
applied...I can show an employer the application and give them the actual
EAD card or SSN within 90 days.

Does this sound correct?

Why would the take the advice of SSA employees about an INS form?

You might want to call the INS Office of Business Liaison at 1-800-357-2099 or
read INS publication M-274, "Handbook For Employers."

Michael,

I actually didn't know about the I-9 until I called the SS Office and
someone there just happened to point me in this direction. My understanding
of this rule is exactly what it sounds like. I have seen posts from many
people, including yourself, saying get a second opinion (as in if the first
person you call doesn't give you the answer you think it should be try
again)

I just thought you might know for sure. I will consult the handbook. I
appreciate the link!

Thanks!
