Default EAD form question (or 2, actually)

Hi all,

So I'm filing for my EAD along with my AOS package. With the EAD form you have to put why you are applicable to file for an EAD, and there are two reasons which sound applicable to me: one of them is C9, which is an adjustment applicant, and one is A6 which is for people who came in on a Fiance(e) Visa. I want to file my EAD paper with my AOS paper, so is C9 the reason that I state?

Also, on the EAD form Instructions, it says that if you are an adjustment (C9) applicant, you should file your EAD form with evidence that your AOS form is pending, but isn't it right that until I have filed the EAD form, I won't have any kind of evidence? It then goes on to say that you can file for EAD together with your AOS form, so can I just do that without providing evidence?

For one, it often takes at least 24 hours for people to read the boards and respond. You aren't very patient. I've found that if you post at night like you did, you won't get an answer until the next night or day after for people who check at work. Also, you often have to post 3 or 4 times here. If the message is more than 2 days old, most of the time it's forgotten.

As for your forms, if you are a K1 and getting an EAD B4 you file for AOS within 90 days of being here in the US, then you use (a)(6). Your proof is your K1 paperwork. But this seems silly since you are allowed to work anyway until you file for AOS and the lags in most offices of 60-90 days make this useless. See Rete's detailed message here about Employment Authorization about 2 weeks ago or so.

If you are filing AOS, which is what it seems you are doing, then you file all of your paperwork together. Your evidence is the fact that there are the forms I-458, G-325a, etc, all in the packet with your EAD. For AOS, you file directly with the office for your area, you do not send it to Texas. Your status when applying for an adjustment of status is adjustment applicant or "pending adjustment of status" and obviously your classification is (c)(9).

I'm not a pro at this, so you have to see which category you are in based on which of these fits your situation.

The second set of circumstances is exactly what I'm doing, so C9 it is. Thanks for your help.

Yes. Very occasionally INS offices screw up the application over this issue
but it's pretty rare - much more common with I-131s filed with the I-485 if
posts are anything to go by.

Good luck with your application. It's a lot of work! The more you get into it though, it looks like rebuilding an engine. Impossible to figure out, but then a snap if you had to do it again. Once you know what to fill out, you could do all the forms in no time. Most of the time would be spent getting docs together, copying them, and clipping it all together.

I married my fiancee last week, we are thrilled! If the timelines are correct and there are no complications, my wife and I will know in about 8 or 9 months for our service center the results. Let's keep each other posted.

Thanks Andy and FR. Andy, are you advising against my submitting my AP form along with the AOS form? And FR, I gather you've already sent your AOS off. We're getting married on Friday, and I hope to get all these forms posted by next Tuesday, so our timelines may be fairly similar. We'll be using the Chicago office; which are you using?

Not all INS offices allow you to submit the I-131 with the I-485
application. I'm pretty sure that Chicago is one of those that doesn't allow
it but you could check the AOS experience pages and INS website to make
sure.
