Question EAD denied- WHY????

I applied for a renewal of my EAD two months ago and today I received a letter form the BCIS they denied my EAD application. Has anyone gone through this before? I came over on an K1 visa and got married as well.

Could be a million and one reasons - have you a new criminal record/ become a terrorist/left partner/no money etc? More info required for an answer - are you a "normal" person or did you have some problems at any stage? All said, maybe it was just an incorrectly filled in bit on your application or administrative error by the some mongs at BCIS. Ring them up and ask them exactly what the drama is.

There is definitely not enough information to know why you have been denied. First off, how do you know you have been denied ? Did you get a letter, what does it say on it ?
My guess would be that since you moved recently, you case may not be in california yet or something, did you file AR 11, informed service center and local district center ?

From your timeline I don't understand why you filed for renewal EAD. Isn't your current EAD good until April 2005 ?

It states that my EAD application is only reserved for people who have a K1 visa. Which is how I came to this country, I am guessing here that they have lost my file while transferring it from TX.

I will be on the phone all day today to sort this out.

Well that is not true for EAD applications in general. However, it is true if you are applying for the 90 days EAD. Which one did you file for?

And what eligibility category had you applied under for your prior EAD?

From your signature I see that your 1-year EAD was approved April 28, 2004. The USCIS website says you should apply for a renewal EAD six months before your original EAD expires.

Six months prior to the April 27, 2005 expiration is Oct 27, 2004. You filed for your EAD renewal on July 18, 2004, more than 9 months before the expiration.

You filed too early -- maybe that's why it was denied?

I currently have a yr EAD but I need to review it. I called them up today and was told that they cannot help me over the phone. So it is off to SF office to sort this out.

I am currently working and cannot afford not to, hence why I applied early, I still believe that is has something to do with a mix up somewhere in the system.

Hopefully, I will find out when I do down to SF.

I only suggested the fact that you applied 3 months too early as a possible reason, because I think I've read on here before that when others have applied for things too early (like removal of conditions) their applications have been rejected/denied for that reason. I could be wrong about that, but I'm pretty sure I came across that somewhere.

In any case, good luck with whatever you find out. Please let us know the outcome.

For removal of conditions and naturalization that is very true. Your petition will be kicked back if received before the 90th day before eligibility.

And the sega continues:
Went to the SF office today and before I even get into this, I will say that camera mobile phones are not allowed in this office. I unfortunately was not aware of this and had to go to the cafe across the street to ask them to hold it for me.($3 was the fee).

The person behind the window, looked at my EAD denied letter, asked me some questions,took my documents and disappeared for a couple of minutes. Next thing I know the person came back with their boss and told me that my AOS has been misfiled and is currently in you guess it " Missouri" even though I filed this at Houston TX walk in. So with all the excitement, my face just started to look completely stressed out.

So after recovering from this comment, I asked what happens now and yes you guessed it. I was told that I have two major options: refile all over again or they will request that Missouri send my file to them. In additon I was told that I have to bring proof that I have paid for my AOS application and photocopies of almost everything.

I have never read/heard any one receiving and AOS acknowledge receipt with out paying for the application.

So now after all this I was told that this could take up 6-8 weeks before my application can be sorted out. Which in turn means I will have to leave my job when my EAD runs out later this yr.

I may even end up homeless the way things are going right now.

They probably transferred your case to Missouri, seems like what has been happening lately.

How did you pay for the fees, you should have a copy of it ?
Did you write to you old local field office in Houston, Texas to tell them that you moved to California ? They should be able to transfer your file to San Francisco.

I don't get it, from your signature your EAD should be good until april 2005 ?
When does it expire ?

You can always get an interim EAD if it has been more than 90 days that you filed for your renewal EAD.
