Default EAD Card

I have a quick question. I have been married for 1 year and currently
pending for I 485. I got my finger prints taken around a month ago. I
just got an offer and applied for I 765. Do I need to get my finger
prints taken again? My job requires me to work by january. Do you think
I can do this? I had an EAD card couple years ago when I graduated. Do
you think this might help me to get a faster reponse?

When you submitted the I-485, I guess you didn't also submit an I-765, and are just now doing so? I assume the fingerprints you had done a month ago were for AOS only, then.

Yes, you'll need to go for biometrics after you submit the I-765. It will be a 1-digit fingerprint scan, and a photo. It seems to be taking the full 90 days to receive an EAD card, so you may or may not have it by January. Previously having an EAD card will not make you get this EAD any faster, no.

I submitted I 485 2 months ago and I efilled I 765 last friday and
mailed the documents to NBC same day. So 90 days from last friday? I
have an offer in my hand and is there a way to expedite this process.

No, no way to expedite an EAD. If you don't get the EAD within 90 days, you can go on the 91st day to your local office and "try" to get an interim. A lot will depend on when you get your biometrics done, though. And I've heard they are not giving out interims as easily as they used to. You might be lucky and receive yours before January. If not, maybe your employer will keep your position open a few more weeks until you get it.

Just out of curiosity, why didn't you apply for the EAD along with AOS? Were you not anticipating working?

I am still in grad school ad this offer came out of no where. I will
just stay put and hope to get this card as soon as possible.

My understanding is that the 90 days begins with when USCIS accepts your application, NOT the day you mailed it. After all, it could take a week or so to get to them, but they don't count mailing time towards the 90 days.

Wait until you get a receipt notice, then go by the date on the notice.

It can also help to have an attorney: I went on the 91st day after the date on my receipt and was refused an EAD from the Seattle office: they officer I spoke with said that the 90-day rule did not apply to Seattle, and would give me no further information. I had a job offer in hand, so I was pretty unhappy.

I spoke with my attorney, and within 20 minutes she called me back, saying that the USCIS had "identified a training opportunity" for the officer in question, and that I could go back to the office the following day and collect the EAD.
