Could you be more specific?

ie. What forms do you have? What is it that's confusing you?

If you came in on the K3 then you file the 765, the EAD form. That form is sent to the post office box in Chicago specified for K3 folks in the instructions. You will receive a NOA and then will make an appointment for your biometrics-fingerprint done at the ASC most likely. THEN you wait to get the second NOA. IF you have NOT received the second NOA by the 91st day after your first NOA, you have the option of going to your local office there in Washington state and getting an interim EAD.
Good luck

Thank you for your advice. I went to local office and they gave me a bunch
of forms for adjustment of status, including I 485, I 130 (again) and
medical check, finger prints etc.

i have already had medical check before i left UK and we have filed I 130
long time ago. That is why I was confused.

so, shall i ignore the rest of the form and just file I 765? is it worth
doing E filing? is it quicker to trace?

Thanks

Dear Cindy

I spoke to one of the ladies from USCIS and she said I can file EAD
electronically and she gave me my category number which is a(9) for K3. It
is not on the form becos the form has not been updated. She said just put
down a(9) and they will know it is for K3.

Thanks

Kmz,

Interesting. The USCIS website says very specifically that an a(9) is not eligible to E-file.

Hi there KMZ,

When I got here on k3, we received the affidavit packet for my pending I-130. I called BCIS just to ask some questions on filing procedure, talked to a lady which gave me information which made me even more confused. She told me to write BCIS and tell them to cancel my I-130 application since I am already here and just apply for AOS (we all know that its not the way it should be, right).

I know that these nice people who answer the phone know their job well, maybe since k3 is fairly new thing, even their staff are not yet familiar with its procedures and stuff. My point is that, you should try and ask around, and not just rely on what answer you will get from the phone operators.

Regards and good luck to your application.

KMZ,
I filed my EAD by mail as I didn't wanted to take chance to delay our process any more as SSN depends on how quickly we get our EAD.

Just for safe side, I would mail it to Chicago address. I am still waiting for 1st NOA.

I am still not sure what will happend to our I-130. May be it is only used to get in US? And now that we are here on K3 as Non immigrant, we just AOS by filling I-485? I think it is good idea to AOS as quick as possible.

Good luck!

Thanks Cindy!

You will always be the K3 Queen to me. I'll be jumping on your K3 EAD roll call thread very soon.
