Thanks for the link Bee. I am in Ohio and my fiance is Dutch. I've been
reading this NG for only a week or so as we try to decide the best route
for getting married and getting him moved here. Based on the horror stories
I have been reading about the NSC, we are looking into DCF now. All we know
for sure is that it is hell being apart and we can't stand it any longer!

Dutch DCF
In the US Family Visa Advocay board (http://pub99.ezboard.com/bk1advocacygroup ) there is another Dutch/US couple doing DCF right now.
Below is a link to their thread about how it is going. I also just got back from filing DCF in Madrid, and I highly recommend it if you can do it. It is much faster, plus there is no adjustment of status after getting here- your green card is mailed to you after arrival. I posted our story about 2 weeks ago in this forum.

Re: Dutch/USA DCF
thanks Bee....that was a thoughtful post. I check in every few days to see
if there are any DutchAmerican couples looking for help. I probably will
post it once a week now that Rete is not here she had it in her
signature.
Hi Heather.....the whole site is www.usadutch.com
DutchAmerican couples have a special privilege in that the American is not
required to be a resident
to file DCF in Amsterdam.
If your Dutchie has no criminal record (and I mean NONE)
has no communicable diseases
and has no overstays in America
then DCF will save you money, time, and headaches. If you read 'Other
Couples' you can get a feel for how to do it if you want to get married in
America or how to do it if you want to get married in NL. You can get
married either country but you (the American) must be present in Amsterdam
with your Dutchie for the initial filing of the petition after you are
married. I haven't posted timelines lately but they are running the
same....50 calendar days give or take a week.

My (dutch) husband and I are just getting through the K1 process and shortly to be filing for AOS. Too bad we didn't have more information on the DCF as we could have saved some time in the process.

The answer may depend on the consulate involved. Depending on the
offense perhaps they would be inclined to work with a waiver (which, as
I understand it, has to be sent to the US and is not approved by the
consulate)

Re: Dutch/USA DCF
Hi Heather
I think Ironporer is talking about us,we are that US/Dutch couple that
are doing the DCF
We have withdraw our petition from TSC and are now working to get
married here in Holland and go for the DCF route
Today I had a call from our cityhall that they approved the papers I
sended to them from my American sweetheart,so now we are only waiting
to hear something from the alienpolice(I had to fill in a curtain form
that replaced the old D79,what cityhall will give to you)
When they will give a note that that is ok too then we are able to get
the marriage license or like we call it "ondertrouw"
I can do that alone since I have give them all the personal documents
from Dan.
And then 14 days later we are able to get married and we will go on
the same day to the consulate in Amsterdam and file for the I-130.
Can tell you that it is really working a lot better then apply for a
visa at one of the Service Centers
My fiance is from Arkansas and I am living in Flevoland(Holland)
I wish you good luck !!!

Just to answer your question regarding the American Consulate in Amsterdam
YES.....the petition is denied if there is any *hint* of a crime. Each
Consulate is different and this one is pretty tight. To give you an
example: one DutchAmerican couple I know filed DCF as he could remember no
criminal record. His criminal check came back with one offence 19 years ago
where he had been accused of driving off from a gas station without paying
for gas.
(He had actually forgotten about it because he did not do it. He had
stopped in for a pack of cigs and then of course driven off. The video
showed him driving off. He went to talk to the gas station owner and the
owner said.....well, I am tired of being ripped off and somebody has to
start paying for stolen gas. He verbally admitted to the Dutchie that he
was not sure if he stole gas but his license plate showed up on the video
real nice and there was no record of him paying for gas. The Dutchie went
to legal aide and they said it is just a fine so pay it....paying it is
cheaper than getting an attorney. So, he paid it and then got on with his
life......then 19 years later he is denied DCF because of this *ticket* and
there was no sentence or probation or any time spent in jail.
Then...what would I do? well, I guess I would start with the fiancee visa
and have it denied and get a good immigration lawyer and file the
appropriate waivers.
I would also plan on moving to the Netherlands. It is after all, a very
nice place to live and raise a family so the hardship waiver is a tough one
to fly.

Its funny you are talking about the way of speaking
I think we dutchies have a problem with the "th"
at least I do,it is like my tongue get stucked between my teeth, haha
I also would say "Hedder" instead of Heather,LOL
But I think there are americans who have problems with the "g"in our words
But it is great to learn, and a lot different then the english we learned at school.
But if you can do DCF I would really say "go for it"!!!
