Default Does changing status in the US mean a IBIS check and not a police check?

Hi all,

Just a quick question.

I'm from the UK, my fiancée is American and in the next year or so we hope
to be getting married.

I have been reading about IBIS checks on this newsgroup.

I also remember seeing a post from someone (I'm not sure if this person was
asking a question or stating a fact) who said that if I was to fly over to
the US on the visa waiver program, which I do regular. But this time I
decide to change status whilst I'm over there, this person said they don't
need a UK Police certificate, they do an IBIS check instead.

Is this correct? If so, can someone give me some of there knowledge on this
matter.

Gavin (UK) & Mindy (US).

Yes that is correct. If you married within the US, didn't leave, and filed for AOS you are not required to get a police clearance certificate from the UK. However, you will still undergo fingerprinting for clearance by the FBI and CIA and a name check with IBIS. I gather you might have reason to NOT want to have to obtain a poice clearance from the UK.

A bit of advice of everyone is remember that when you complete the AOS petition, you will be asked about past criminal history. Lie on the petition and the past might come up and bit you on your tussy. It is knowingly committing fraud and grounds for deportation if discovered. Never under estimate the enemies you have made. One might take great delight in informing the INS of your history.

I do have a reason for Not wanting to obtain a Police clearance from the UK
but I'd like to point out, not on criminal grounds!
Before any one gets that in to there heads.
